Top Real Estate Companies violating laws by selling school land within Group Housing Societies

On front page in Hindustan Times today, there is an advertisement by one of top real estate companies of India of selling nursery and primary school plots measuring 0.2 acres and 1 acre respectively within Group Housing Residential Societies in Gurgaon. Same real estate company is also linked to 2G spectrum scam.

This is in gross violation of Haryana Apartment Ownership Act, 1983 and Haryana Development and Regulation of Urban Areas Act, 1975 which specify that common area within group housing residential society can't be sold to 3rd party and builder/developer should construct primary/nursery school(s) at its own expense. This unfair and unlawful practice is now being followed by builders/developers in Faridabad also.

As far as I remember Haryana High Court Judgement in DLF Silver Oak case was that common areas cant be sold and only the residents of the apartment have the right to use the facilities.

Giving the advertisement in the news paper looks to be gross violation of the laws. DTCP should take action in this case.
