Unjustified demand raised by BPTP for Park Elite Floors

Dear Forum members,

This has reference to the recent demand raised by BPTP in respect of Park Elite Floors. Those of you who have received this demand must have observed that BPTP has increased the super builtup area and have accordingly raised the demand. Moreover, they have not provided any details regarding the basis on which the super builtup area has been increased. They are not providing answers over phone and are flatly denying to provide any maps in this regard.

I have come to know that some of the allottees have moved the consumer court in this regard. We are four members who would like to join this fight against BPTP. I request that we may be contacted on mobile 9810585747 or write to us at vikkibans@gmail.com.

I am also planning to go to consumer court or any appropriate legal forum for a redressal. However in view of the agreement, I believe, we have to go through an arbitration process also. For the interim my lawyer has secured a court stay against cancellation of allotment by BPTP as threatened by them. We would therefore get time to plan further.

How did you get court stay even before approaching court, as you mentioned that you are planning to go consumer court?

As suggested, I had paid Rs. 500/- vide cheque no. 852165 dated 10th August drawn on HDFC bank towads GFWA membership. The said cheque has already been debited to my account. Therefor you are requested to allow me become the member of the fourm with access right.

Today I have received the demand against the increase in costs of Elite Floor unit - 250 sq.yards GF.

Please advice if any concrete legal action has been taken by any one, and what is the status of the same.

I would also like to be a part of the court case, if any, already in process against the demand by BPTP.

We have already in court and fighting with BPTP. To adding a member in this stage a little bit difficult for us but one our group also initiating for case and you can go with them.

Hi All,

Is this to the reference of the Enhancement which the BPTP has asked for. I also feel that the Enhancement for the 300sq. ft which is around 3.75lacs is too much. If I am wrong could you please throw some light on it.

Another missle fired by BPTP in serving an enhanced EDC charges letter. The rate presented has no justification as to how this rate was reached.

Haryana vide Memo No. HUDA.CCF.ACCTT-I-2011/17903 dated May 25, 2011 and Memo No.
HUDA.CCF.ACCTT-I-2012/8211 dated March 5,2012.
Reference: Floors No. XXXXXXXXX, being constructed at plot admeasuring 250 sq. yd. in our project
Park Elite Floors, Parklands, Faridabad, Haryana.

Dear Sir,
This is to inform you that vide the above captioned Notifications, the Government of Haryana has enhanced
EDC rates in respect to the licenses granted by Director Town and Country Planning, Haryana ("DTCP") in
Faridabad w.e.f. 2005.
As per the above notifications, the revised external developement charges (EDC) are Rs.3,975,821.00 per
acre retrospectively w.e.f. 2005. On account of the above revision, the Enhanced EDC of Rs. 1174/- per sq.
yd is applicable & chargeable to floor owners in 1/3rd proportion of their respective plot area.
Hence, the amount payable is detailed below-

I think the concern that you have raised applies to all the property holders of park elite floors. Now, going through the posts, it seems that we all are the victims but my concern is are we looking for any remedial action.

Please let me know if we have any solution to this problem.

Registration Bluff in Park Elite Floor

BPTP had started offering possession from August 2012, in possession offer it was clearly mentioned that within 90 days they will execute the conveyance deed. But they started their bluff game and nobody got their registration within said period. At last registry happened in the month of March in P and Q Block. Congrates to those who got this happened. Approximately 10 families shifted in P block. Others were getting Proposed Dates only, as I got 13th March and 20th march, after that before 15th April then 10th April, 12th April, 17th April, 24th April and one major date ie April 2013. After that May 2013, now they are saying you will receive on mail from BPTP for proposed dates at the end of June 2013 :bleh: (this is BPTP action to us) .

Hopefully BPTP is thinking that we are fool who had invested in their projects.

It's an appeal to all interested members to join hand to come forward to crack this Bluf Game played by BPTP. We should be in this mood. :@
