I have also received the letter yesterday for Increased EDC payment for Piyush Heights. I hold a two BHK flat in this society.

Can you please send me draft letter once again on my email ID so that I will reply to the builder accordingly.

Dheeraj,

What should be our response If they are sending a newspaper cutting as a proof. I haven't received a reply from them but they may:-

1. Tell us to follow the newspaper information and pay the extra amount.
2 Can pressurize us buy saying that it is an 3 months old notification and hence we have to pay.

@Pramod, to answer your questions

1. I agree with you that they may cite Newspaper clipping. But, newspaper clipping mentioned that this notification is for licensed colonizers. What if Piyush Heights license is canceled due to non-payment of previous EDC? We are having RTI replies that say that licenses of some builders in Neharpaar/Greater Faridabad are canceled due to non-payment of EDC to Govt.. So, we should ask for letter that is sent by Director, Town and Country Planning to Piyush Group. We are having such letters for other builders.

2. We are having no problems in paying increased EDC. We should say to them that since this is an Govt. demand and NOT a builder demand, they should show us all Govt. documents, certified EDC calculations and proofs of submission of previous EDC amounts to Govt. Also, matter is under sub-judice in High Court, that is why we are asking for increase in due date for payment of EDC.

I am also received letter asking to pay increased EDC from Piyush Group. I will send letter as per prescribed format to Piyush Group. It make sense if we all can meet tommorow at piyush height at 11 am to plan future course of action. pls confirm by posting your replies.

Heights is filling a case in next week against Piyush Heights. If anyone

Dear All,

Good to see we have Piyush Society with which we can discuss the matter regularly. In regards to the above Subject I have already send the mail to Piyush to extend the Period for Deposite the EDC amount Provided they can provide all the documents which pertaining to the Earlier EDC amount to be deposited to the Authorities and the frest letter from Authorities for EDC demand.

Till now I have not recd. any confirmation from Piyush agn. my mail. Once recd any intimation will definately post the same. Is anyone have any info in regards to the Result of Case today is 6th Sept.

If anyone has any info please share for the benefit of all.

Hi,

I dont know what's the result but court quoted something for the buyers who are getting possession, not to stop it due to increased EDC.
My question is- What should be our course of action?
I did posted the mail to Builder but piyush group is not replying. They just sent the newspaper cutting scanned as proof no answer thereafter.

Do anyone visited the Piyush group office(I am staying outstation) or, any idea what builder is saying on - if EDC not paid on time. Are they ready to wait till the Honorable high court ?

Hi

Yesterday I called up Piyush office and asked them to extend the date for EDC payment, as Court has verbally communicated, not to stop possession.
But they refused to increase the date, stating there is no written communication from Court.
But they said, we can pay the EDC charges, and in future if the court provides any stay or written decision, then they will refund the amount.
I said to give this in writing, but they said it will take time to give this in writing.

Hi Amit

Can you please call again Piyush Group to say this in writing that since there is no written communication from Court, they will not extend the date of EDC payment?

We don't have any issue. We will get the order in writing from honorable High Court

Dear members,

I heard from some other thread that if a flat owner does not play a demand on time, then the builder may not consider giving us the amount in case of delay in possession.

Also what is our strategy as far as paying the EDC is considered as I think we don't have any updates from the court.

Please advice.

Hi,
I did not receive any response to the registered post to Piyush Heights office, I had mailed regarding EDC breakup/extension of deadline etc. I called up the office and the lady who answered the phone told me to get the EDC breakup etc. from the RTI office sector-12 faridabad. She said it would take time of 3-4 days for Piyush Heights office to get the details themselves. I think it was a bluff and they do not intend to respond to the letters. Also, she said that if the court decides in our favour, then they would refund the money. However, not ready to give this in writing.
Since, there is a divided opinion in depositing the increased EDC, I am deciding to deposit the same as my date is also overdue. Other people who still have time till 25th September can take a more collective decision based on this forum's discussion.

Hi Pramod,

I think we had already getting the possession delayed, have you got any assurance that the builder is going to pay the said amount in case of delay in possession?
Please go through the buyer's agreement it has lots of clauses, behind which the builders can cover themselves.
