The builders difficult times had started in March april 2014 because of court case and the pressure is on till today and it will increase with time.

Whatever. I don’t know how much the builder is suffering from your creation of the pressure but this much I am sure that majority of the buyers are really suffering. They had not bargained for it at the time of booking of the flat. The delay in possession is adversely affecting all the buyers not only financially but also mentally. As a responsible member of the buyer’s group, we all must also consider all aspects that may affect the buyers.
For an average buyer, legal or illegal possession is not a matter of concern, they would like to have the key of their flat in their hand, which can save them from multiple problems they are facing. Other legal things can be tackled later. Nehar paar is full of such examples that all know of. Our group is trying to work on similar approach to benefit all the buyers and expect cooperation and support from all concerned

Dear Friends

We all are fighting for possession of Era Divine Court Flats in Sector 76 of Faridabad. We had been using various mediums for communicating and with advent of instant messaging we have moved to Whatsapp/Telegram, etc. Recently, many Whatsapp/Telegram groups have been created for Era Divine Court buyers with different Admins. It very heartening to see that many new people are joining the fight for possession of much delayed flats.


But creation of so many groups is really helping us in achieving possession of flats or taking us away from our goal. We all are fighting for flat but are not united in our struggle. We should not let our ego come in the way of uniting as a single unit for taking possession of the flat. It seems that we are inserting our self esteem and personal work culture into group running business to differentiate one buyer from other whose only aim is to have a flat for living. We should infact act as a goading element and help to unite all the buyers to work as a team to achieve what has not been done since 2009. We must tolerate each other and respect others opinions. As I may be wrong for you and you may be for me.


Who is going to benefit most from rift between all of us! Of course the Adel Landmarks Ltd. They have always tried this tactics and to a great extent they are successful also else, how can you explain that we are supposed to get flats in 2011 but still don’t know when we will get it. What we need is that all the buyers on a common platform without any prejudice. There may be differences of opinions but that can easily be sorted out if we sit together and talk. Nothing is impossible.


Giving physical possession of the flat is not in the hand of Adel (Era) Landmarks Ltd. They are dependent upon BPTP for the same as you all know Land on which Era Divine Court is being built is with BPTP alongwith License. Most of us have taken bank loan for buying the flat and also paying rent, so it is easily understandable that we want flat with OC or without OC and they are right in demanding so. It is ones’ personal decision. But whatsoever promise Adel may make to us, it must be understood that until and unless legal tussle between them is not cleared, WE ARE NOT GOING TO GET PHYSICAL POSSESSION OF FLATS WITH OC/WITHOUT OC OR WITH REGISTRY/WITHOUT REGISTRY. There is substantial sum of money Adel has to pay to BPTP and due to apathetic attitude of Adel toward handing over the flat, we have deprived of our dream of a home. Recently govt. has passed an order for transfer to License to Adel but that needs some formalities to be completed with a payment of a paltry sum of money. But instead of solving them both builders are playing passing game and it seems that Adel is not at all in hurry to hand over the possession of the flat.


Most of the buyers booked flat in 2009 and were supposed to get the possession of the flats by 2011. But now we are in year 2015. It is almost six years since the booking of the flats. People waited till 2014, that is lapse two year after the actual date of possession before plunging themselves into the legal battle. Since 2010, there were many meetings/deliberations with Era management, even with CEO of the company, but was provided with assurances nothing else. It was learnt that meetings are certainly not going to give possession of the flat and our money is at stake. That was high time to do something which should be result oriented. And it was decided to move to the court in 2014 after FIVE YEARS FROM DATE OF BOOKING and result is quite evident. But we need support of all of us, if we have to get early possession of the flats. We must devise a way how to come on single platform by putting aside our differences then only we will get our flats.


Most importantly, we all are buyers of Era Divine Court flats and are going to live together there after possession of flats as a friend and brother. So, why should there be fighting amongst us? We will all be neighbours in Era Divine Court Society, therefore, we should spread brotherhood for a wonderful society and peaceful life.

So lets get united and work for early possession of the flats. I may be wrong with words stated above buy not in my intentions.

Friends,

Please do not display your anger,frustrations in public as i have personally observed that builder community is watching the forum on day today basis.

Pick up the phone,sit together, discuss and resolve the issues/fight jointly as all the allottees are victims of the mighty, arrogant builders and authorities as well. They are working in co-hoots.

Take all the challenges together.

Dear Umesh Sir,
We agree with your points and respect your views, but if you may see properly, this is not a fight going on amongst two different groups of buyers. Rather it is an honest and open exchange of opinion and views on both sides. This will help both the groups to come at a common ground and same page of understanding. This is a process which if followed keeping personal differences and ego aside can ultimately lead to united stand of all the buyers. Even the builder community will worry about it. We will require your valuable guidance and support in ensuring that it happens seamlessly.

I got some queries from one of my friend and He said I must clear the doubt one person has in his mind. I am trying my best to do so and after reading this still you have doubt, you can ask for clarification. I have shortened the questions to make all this not lengthy.


You must know RWA is long defunct and registration expired long back. However it was registered with good intention to facilitate early possession of the of our flats and after that management of society which we will have to do as per govt. rules. Now, there is no RWA, We are working just like friends, no President, no Secretary, no Members, we all are equals.


Query 1 : How Lawyer Fee was Finalised………?

Ans : We are only 12 people who filed Writ Petition in Chandigarh High Court in Nov. 2014. NO CASE HAS BEEN FILED IN CIVIL OR CRIMINAL COURT TILL DATE. YES, NO CASE. We 12 people do not have anything to do with rest of the Era buyers, even most of the RWA members were not part of this. We were sufferer and we wanted to have our flat without troubling anyone else and we 12 people were of the same view, so we filed Writ petition. WE PAID THE LAWYER WITH OUR OWN HARD EARNED MONEY. DIDN’T TOOK A PENNY FROM ANYONE. IT WAS OUR DECISION. WE PAID 2.5 LAKH TO THE LAWYERS FROM OUR OWN POCKET. People only contributed partially only after when they knew that an Order has been passed by Chandigarh High for early possession of the flats. We did not take money initially but after repeated requests, we started accepting contributions only to facilitate other people who wants to go to Chandiargh for hearing of the matter. It was all voluntarily, there was no compulsion, we asked whosoever have same thinking with the process we are following, may contribute. We have not asked money before also and not ask in future also. And people contributed between Rs. 500 to Rs. 5000 as per their convenience. There was no bar on money of Rs. 1500. It was ones personal choice. All the expenses would be shared from whatever we have collected till date.


Query 2 : Transparency of the Fund collected at the time of Formation of RWA….

Ans : Yes some fund around Rs. 7-8 thousand were got collected during the formation of RWA. All the statement was circulated in Era Divine Court forum on commonfloor.com. Whosoever is member of that forum can check. We have time and again circulated the statement and it is still there. Everything was transparent. We are still circulating all the names of contributors in whatsapp. First expenditure after recent collection had happed this Wednesday while visiting DGTCP office and this will be shared on Sunday.


Query 3: Betrayal by a member and Question on our Intention with a view that we are builder’s agent

Ans : Yes one person took advantage of the situation. But does it mean that all are alike? No, we all are different person with different view. And WHAT IS THE GUARANTEE THAT YOU ARE NOT WORKING ON BEHALF OF ADEL LANKMARKS LTD TO HELP THEM AND YOU WILL NOT NEGOTIATE FOR YOUR OWN BENEFIT? WHAT IS THE GUARANTEE THAT YOU HAVE NOT BEEN HIRED BY ERA TO PERSUADE PEOPLE TO NOT TO FILE CONSUMER CASE, SO THAT ERA HAS NOT TO PAY ANY COMPENSATION FOR DELAY PENALTY CHARGES, UNFAIR TRADE PRACTICE AND MENTAL AGONY WE HAVE GONE THROUGH AS THIS SUM MAY BE UP TO 10 LAKH PER PERSON? If the trust deficit remains like this, we will keep on fighting and Era will take advantage of our situation. We bought flat in 2009 and still here but you bought much later. We could have negotiated long back if we had to exit this project and earn benefit. But we want our flat and that’s why we are fighting tooth and nail. Nothing is hidden, everything is clear. Nobody is forcing or misguiding anyone, one has to follow his instinct whether court case is farce or not. Use your wisdom and you will understand.


Query 4 : Taking decision unilaterally and dividing buyers….

Ans :

We bought flat in 2009 and started organizing in 2010. We organized numerous meetings with Adel Landmarks Ltd and we have video proof and email (sent by Adel to us) for this. Time and again various buyers used to meet at various places. We had meeting at Era site, Town Park Faridabad, Connaught Place. All were invited, no one was barred just as you are trying to do. The result was CNN-IBN episode. First, I do not believe in group culture, it is you who differentiated one buyer from other. IN 2013 WE WERE MORE THAN 200 FRIENDS OF ERA DIVINE COURT FLAT OWNERS ON COMMONFLOOR.COM. DID YOU KNOW THIS? We did not need more support to fight for our flats. But we believe that all the Era Divine Court buyers are brother/sisters so we always tried to walk on same path. Very sad to say you saying is like just like dividing two brothers. I welcome all, you too if you have open mind to understand thing. As I said before, had we intention of settling down with builder, that had been done long time back.

Query 5 : Court Case filed in 2010….


Court case filed in 2010…..wherefrom you got this information which is not even know to us? No court case was filed in 2010. Instead, we have not filed any civil or criminal case as I stated before. Some people tried to file FIR against them in 2013 but that was rejected. We filed Writ petition in Nov. 2014 and Writ is not court case. Now some people are filing Case for compensation in Consumer court. Court Case is going between BPTP and Era Landmarks for payment dispute.

We do not believe in negative propaganda, we believe in truth which should be known to everyone whosoever have bought flats in Era Divine Court. Instead it is you, who removed us from your group, without going through facts. Who is presenting wrong facts? If you know all the truth, you will not say so. The 100% payment comment was made by Mr Naveen on myfaridabad.in. But Mr Naveen is no more part of Era Divine Court Society. He has got flat in Redwood Residency. So he doesn’t have anything to do with Era Divine Court flats and what he says does not concern us. Interestingly, what I read on myfaridabad.in, Mr. Lalaraju, who is also an important functionary of Faridabad development, seems to know all the fact and admire Mr. Navin somewhat. But we don’t have to do anything with this.



We believe in unity. We believe in harmony. We believe in Brotherhood. We believe that once we got flats we will be good neighbors who can make a society worth to name.

It is true that builder had demanded maintenance in May 2014 as they were planning to provide physical possession to the buyers but they retracted due to the on-going court cases. They didn’t take maintenance amount rather they returned the cheques to the buyers who had sent it to them. Now our group will again try to negotiate with the builder to offer physical possession to the buyers as all have suffered a lot and the time has come to end their misery.

In my opinion you are a fighter and will continue to be. Coward People will continue to raise fingers and no one can stop them stating irresponsible words.
