Haryana Govt. Nexus with Builders exposed by GFiles Magazines - Files PIL in Supreme Court

HI All

GFiles Magazine has filed Public Interest Petition in Supreme Court which seeks intervention of Court in ordering investigations and malpractices going in Haryana in real estate. I bought magazine today (February 2014) and it is having more than 50 pages of facts and evidences against HOODA Govt. of acting in collusion with builders especially BPTP. It illustrates how real estate polities and guidelines were molded to favor builders. Magazine alleges that Haryana Govt. is virtually run by BPTP and DLF. Try to get your copy of magazine to read facts and evidences.I am starting a series of articles which are having scanned portions of magazine and covering how this nexus works.

First part exposes how Haryana Policies were made in years from 2005 to 2014 during HOODA tenure which were driven by BPTP interests and other builders. Please find attached.

I have selected Questions for HOODA for Politician-Builder Nexus asked by GFiles Magazine (gfilesindia.com)

1. Has Haryana Govt. ever investigated the antecedents and credentials of the companies before they were allowed to acquire land in Haryana and engage in colonization, buildings and consolidations of land?

2. Has any one, including the income-tax department, ever enquired the source of funds flowing into these companies, as also the fact whether their net wort matches to that of the value of the land they own or have acquired?

3. Has the Haryana Govt. asked for compliance reports from builders, colonizers and land consolidators regarding the completion of the projects, as claimed by them in the newspapers?

4. Has the Haryana Govt. investigated why builders, colonizers and land consolidators are charging extra amount on flimsy grounds from customers due to the delays in the project, whereas the customer is not responsible for any delay?

5. Has the Haryana Govt. developed any mechanism to address and rescue the customers from the clutches of builder's mafia for non-compliance of terms and conditions of buyer-seller agreement and delay of the project?

6. What was the rationale behind Chief Minister Hooda holding all departments relating to land and urban development with himself? Was there no competent MLA in entire Haryana or was it to control land deals?

7. It is true that your Government has not utilized more than Rs 10,000 crores collected towards External Development Charges (EDC) from the end consumers through the builders in the last 5 years for creation of basic amenities?


8. Why did you shift the powers of the DTCP to grant or refuse the licences to the office of the minister in charge, which happens to be the Chief Minister? Don't you agree that this was done to directly give massive benefits to builders like BPTP?

9. Why did you bring in the policy of removal of height restrictions for Group Housing projects? What was the rationale behind increasing the per hectare population density in Haryana? These orders allegedly doled out direct benefits/favors to 391 group housing societies.

10. You have allegedly created three Master Plans which will create concrete jungles without providing basic amenities of roads, water, electricity, sewerage etc. Your comment.


11. As per the norms, one plan is implemented in full and only then another plan is envisaged. You have stated that you will implement Master Plan of 2031?

12. Why you have created a virtual monopoly of builders in different parts of the State? Like in Rohtak, Sonica builders control 67% of the total land licence, BPTP in Faridabad etc. Same story is there in every district of Haryana

13. Why no action is being taken against the shell companies and subsidiaries of various builders which bypass the land holding laws in the State and also avoid paying registry charges on transfer of ownership of immovable property

14. It is alleged that the proposed changes in the Master Plan were leaked to favored builders like Ramprastha, BPTP etc. who took advantage of such information and purchased huge stretches of land in the very sectors, hence benefiting to the tune of thousands of crores.

15. It is alleged that the Haryana Govt. is run by de-facto Chief ministers like Venod Sharma, Kunal Bhadd, Arvind Walia, Anil Sharma, Sameer Gehlaut, K.P.Singh and Kabul Chawla. What made you allow these extra constitutional authorities to act on your behalf?

It was March 2013, when Chhattar Singh, Principal Secretary(PS) to the Chief Minister of Haryana was about to retire and the new incumbent has to be selected. There were many officers in line. At the time, I met one of the senior-most officers, who too desired the prestigious post. We discussed the possibilities about who would be selected by Bhupinder Singh Hooda, the Chief Minister of Haryana. In the discussion, he said that the selection required the tacit consent of Venod Sharma, the controversial Congress MLA and liquor baron.I was taken aback. He further said that not only Venod Sharma, but the PS to the CM also needed backing of the influential builder lobby of Haryana. As a journalist, this was the first clue to the Cover Story that we carry in this issue. I sensed a big scam. Following this conversation, I toured the State many times and met a lot of leaders, officers and common people. The story built up slowly. What our Associate Editor Neeraj Mahajan unravelled was shocking - a complete surrender of the State Administrative machinery before the almighty builder mafia. I have been covering Haryana for the last 31 years and in my experience, no Chief Minister had ever been influenced by an extra-constitutional authority in the selection of a PS in the Chief Minister's Secretariat. Not only the PS, but also the District Collectors and Superintendent of Police (SP) have always been the personal choice of the Chief Minister

The State has approximately 200 builders, who are constructing the so called modern Haryana. It is astonishing that these 200 builders have around 20,000 companies registered with the Registrar of Companies. How the web of these companies is allegedly converting huge amounts of black money into white and vice versa, is a matter that needs further investigation.
