Congratulation & all the best for great efforts about possession & all others pending issues. I am in touch always with all of you through “GFWA”. Please add me in your group & save my mail ID as PKTYAGI9@GMAIL.COM for future communication & updating for meeting & other issues. I have a unit in B-1 tower in Jade (Summer Palms) project.
I have called to URPL about delay possession, construction quality, change in construction as per master plan & approach road development. But I could not receive any satisfactory answer till date. As per agreement they are delay to give the possession. I don’t know where our money is for EDC & IDC. We have paid same to builder so it is the responsibility of builder about external development progress for road etc.
But it is the business in builder language. They have a close grip around our neck. We are bounded through buyer agreement.
I hope finally for best result timely.

Hi Guys

A suggestion:
I believe, it’s high time, we make and register an RWA for Umang Summer Palms. This will not only provide a proper channel for member grievances, but also would be a legal entity to put pressure and challenge excesses by the builder, if necessary. It will have greater impact than each of us raising issues individually with the builder/government. When we meet next time on 19th August, lets contribute a token membership money (Rs. 1000 or 500 whatever all agree) and start the process of registration of the RWA. I guess minimum of 7 (or is it 15?) members are required to form an association. The more the better.

Hi,

I have received a demand letter today regarding the enhanced EDC charges. Umang is calculating enhanced EDC @ 130.48 per sq. ft. and there is an additional charge of 12 per sq. ft for labour cess. So, accordingly my total EDC comes to Rs. 1,77,815 (on 1,248 sq. ft).

Please advice if any of you have also received the same and what should be the next plan of action

Hi All,

I've received an demand letter from Umang Realtech for making the payment of enhanced EDC and Labour Cess by 15th August 2012. The details are as follows:

1. Enhanced EDC = INR 205636 (1576 sq ft. X RS 130.48 per sq. ft)
2. Labour Cess = INR 18912 (1576 sq ft. X RS 12.00 per sq. ft)

Total Amount = INR 224548

Please let me know the course of action on this.

I too have received a demand letter from Umang Realtech regarding enhanced EDC charges and to be paid by 15th Aug 12.They have mentioned a hidden clause in the original agreement .this is something which is just to harass genuine buyers.There is no mention about date of possession.
I have booked flat A2/405.
Rest fine.Please advice future course of action

I have also received the letter on increase in EDC @130.48 per SQFT. Would request if someone can mail the minutes of last meeting with Uppal.

As per the payment terms 100% of EDC & IDC was due on casting of 3rd floor. In all probabilities almost all of us have already paid this long time back.

As per the builder's letter this change from the authority was notifoed vide a memo dated 30.12.11 and we had paid up 100% of EDC long time back. The delay in possession is also at builder's end. In case builder would have given the possession as scheduled, this liability won't have come to us at all.

In the agreement there is a clause on possession, clause 7, and as per clause 7.1, construction work shall be completed with 36 months from the date of commencement of construction and they ahve already exceeded this period.

There are 2 key points I want to put on table for everyone:
1. We have already paid 100% of EDC long time back
2. Because of the delay in possession this hit is coming to us
Aren't tehse facts strong enough to fight this out either with the builder or the court of law?
