Harassment by Omaxe Spa Village

Dear Team
- I had booked flat in Castle Tower in Omaxe area 1900 sq ft in year 2008.
- As development of area and project was not moving forward, as expected, we requested Omaxe to cancel booking and make a new booking in Aspen for new flat area 1600 sq ft.
- - In year 2010, new allotment letter was given to us for smaller flat on stamp paper. All payment, as we had made in year 2008 was transferred to new flat.
- Since then, we have been making payments to Omaxe as per construction plan.
- Suddenly we get a letter from Omaxe in Oct2012, highlighting we need to pay interest charges as Rs 5.88 Lacs for delay in payments. No details for interest charges/ calculation were furnished.
- We contacted Omaxe customer care. We were told to make a personal visit to Omaxe HQ in Kalkaji.
- I am in Mumbai and made an urgent trip to Omaxe. I visited them on Oct17th by spending Rs 20K on air tickets.
- I was given a strange explanation by Omaxe Customer Care team. They told me in my original booking in 2008 there was delay in payment. Total accrued interest cost due to this delay is Rs 5.88 Lacs.

My Question to Omaxe Team:
Why you had not highlighted this to me from 2008 to Oct’2012 in any form.
Why you had not deducted accrued interest cost while transferring my payment to new allotment made in year 2010.
Omaxe Team is maintaining dead silence on subject. They just keep on repeating “As per Policy you have to release payment”.

My Question to Forum:
Does any one have similar experience from Omaxe.
What options do you foresee I have.
Any group members who can help me here,

Hi Rajesh

Almost all builder follow this to a varying extent.. If you ask a ledger report on payments and outstanding, they never show any outstanding payment, just a small line with astrik mark that it does not cover interest on delayed payments, (even if the delay was for a single day, or was caused due to problem from bank/builder)

Omaxe have been doing these with most of the buyers of OSV.
We have been trying to converse with Care team since June but Omaxe is very arrogant in their response and dealt with highhandedness.
Real potential threat is looming large in terms of probable area increase without change in layouts.
Be ready for it.

I agree with Shiv. But Logically, super area should reduce as ;
1) Open area got reduced due to 24 meter road between OSV & ONH
2) High number of units being constructed in ONH

Is my understanding correct?

Anyways, we should starting forming a larger group to fight against such requirements from Omaxe.

SPA Village was advertised with many features but were cut down because of ONH

Hi Sunil,

I have bought a property in OSV few months back only... so not sure what all omaxe had promised. But whatever they had committed earlier to you (or other buyers), they should comply.

Has omaxe officially communicated, that what all features agreed earlier , would not be provided now. May be we can try to list down such issues & take up collectively with omaxe.

Whats way out. Do you feel joint meeting with Omaxe will help out.
With respect to my harassment concern, I am sending them email reminders every now and then which are not getting replied.

Hi Rajesh,

You should collect some documented evidences to prove that their demand is unjustified. Moreover, as I learnt from someone is "builders can't charge interest on interest."

Hi Guys,
I have been sending various emails to care@omaxe.com, which are not being replied. I had made personal visit as well to Omaxe Kalkaji office, wherein they refused to share any details in writing. I have sent them an email highlighting all this and mentioned it could be just a mistake by Omaxe in sending me letter. I am treating chapeter as closed.
However I am sure Omaxe will come back demanding interest cost at time of posession.

Now we are hearing they are increasing total built up area, which means additional pay out.
Have you guys received new second last demand letter. Has any one paid this.
Let me know how to handle this gundagardi.
