Registered deed to be given within 90 days of receipt after obtaining part completion/completion certificate

While going through, I came across an important announcement made by Sh. S S Dhillon IAS Director, Town and country planning Haryana published on 16/11/2007. I hope it will benefit to all of us in Neharpar area



• DEPARTMENT OF TOWN & COUNTRY PLANNING, HARYANA

As per Haryana Apartment Ownership Act, 1983, it is mandatory for the purpose of transfer of ownership of an individual apartments in a Group- Housing Colony, Integrated Commercial Complexes, Cyber Park and Cyber City for which licenses were issued under the Haryana Development and Regulation of Urban Areas Act, 1975 (Act No. 8 of 1975), the colonizers of such properties/buildings shall duly execute and get registered a deed of declaration within a period of 90-days after obtaining part completion/completion certificates under the rules framed under Haryana Development & Regulation of Urban Areas Act, 1975 or occupation certificates under the rules framed under the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963. Failure to comply with, is punishable with imprisonment of either description for a term, which may be extended upto 3 years and shall also be liable to pay a fine of Rs. 50,000/- and Rs. 10,000/- for each day for continuing offence. Various individual notices have been given to the colonizers but the legal provisions of the above said Act are not being complied with, by most of the colonizers. Therefore, through this Public Notice:

i) Colonizers,who have obtained part completion certificate/occupation certificate under the Prescribed Act/Rules are advised to ensure that the deed of Declaration is filed positively by 28.11.2007, and

ii) Flat Owners in the licensed areas, where part completion/occupation certificate has been granted, are advised to get the Deed of Apartment executed, by paying Stamp Duty as per law, by 14.12.2007.

Though there is no requirement to give this Notice, this Public Notice is being issued in Public Interest to make the concerned colonizers/allottees aware about the violation of the law being committed by them. This Public Notice may be treated as individual notice to all such violators of the provisions of the Haryana Apartment Ownership Act, 1983 and the Haryana Apartment Ownership Rules, 1987.
