SRS RWA gets stay on constructions post 2007

SRS RWA has got STATUS QUO (stay) on constructions post 2007. Also, its Managing Director has been summoned by Court.

Faridabad News: On the behalf of GFWA and with reference to news updated on 31-12-2012 about the civil Suit against the M/s SRS Real estate limited for their project SRS residency Sec-88, Greater Faridabad, we would like to update
you on the progress in the Civil Suit against M/s SRS Real estate Ltd.

Under the Civil Suit application, a summon was issued to SRS’ S MD Mr. Anil Jindal to appear in Court on 7th Jan’13.

On 7th Jan’13, Hon’able Court listened arguments put by SRS residency RWA and M/s SRS real Estate Limited.

During arguments, RWA argued and quoted before Court that M/S SRS Real Estate Limited Leased out the land within the Society campus to third party by illegal means and illegal construction of School was going on which was collapsed last month and 06 labours were found dead in that mishap.

Same time, RWA put facts before the Court and shown that the Site Layout plan which was shown to customers during Booking of Flats in 2007 is totally changed by Builder and no consent was taken from Home buyers. Which was against the Government policies.

So, after listening all arguments from both parties (from RWA and M/s SRS Real Estate limited), Honorable court accepted RWA plea and put an order of “Status Quo (Stay)” on school site till further order & hearing on 6th Feb
2013. As per Court Orders, till further hearing construction work on school site construction can’t be carried by Builder.

The lawyer from DTP-Faridabad office was also present during hearing and arguments, but no question was put from the DTP Side.

Good Efforts from SRS RWA. The decision on this matter will be greatly helpful to other RWAs also as almost all the builders have changed their original layout plan without the home buyers consent.
The DTP lawyer kept silent...clearly shows the hand in hand with builder.

ग्रेटर फरीदाबाद में लेआउट के मुताबिक न बनने वाले हाउसिंग प्रोजेक्ट के खिलाफ हाउसिंग सोसायटी की आरडब्ल्यूए को कोर्ट ने स्टे दे दिया है। डिस्ट्र्रिक्ट सिविल कोर्ट ने अदालत की कार्रवाई पूरी होने तक संबंधित बिल्डर को किसी भी तरह का निर्माण न करने का निर्देश दिया है।

हाउसिंग सोसायटी की आरडब्ल्यूए प्रधान नरेंद्र छाबड़ा ने बताया कि 2007 में संबंधित बिल्डर के पास फ्लैटों के लिए बुकिंग कराई थी। इस दौरान हाउसिंग सोसायटी का लेआउट प्लान दिखाया गया था, लेकिन बिल्डर उसके मुताबिक निर्माण नहीं करा रहा था। उन्होंने बताया कि इसके खिलाफ सिविल कोर्ट में याचिका दायर की गई थी। इसमें मांग की गई थी कि लेआउट प्लान के विपरीत बन रहे सभी निर्माणों पर स्टे दिया जाए। ग्रेटर फरीदाबाद वेलफेयर असोसिएशन के मीडिया प्रभारी अजय यादव ने बताया कि कोर्ट ने 7 जनवरी को स्टे देकर कार्रवाई पूरी होने तक सभी तरह के निर्माण पर रोक लगा दी है।

The proactive step by SRS residents led by its RWA has put the unethical & greedy builder in Blackfoot. This exemplary initiative has reinforced our belief in justice step. Such steps would definately deter the builder from taking any unethical or unjustified steps. great job SRS residents. The same lesson can be taken by other RWAs across NEHAPAR to contain the greedy builders

I think the collapse of school building and death of 6 labourers has a huge bearing on the stay provided by the court,and in front of court DTP advocate might not say what DTP says to all in open -that DTP has nothing to do with the BBA that you signed with the builder at time of booking(or did you consult DTP before giving the booking amount).

Otherwise the change in layout plan is most common .At least 99% of such projects in INDIA are completely different from what is shown to the consumer at the time of booking.
Hence i think this court order of stay should not be generalized because of its impracticability.

All marketing and advertising industry depends on Hype and exageration.

Change in layout with stake holders consent is dealt very seriously by other agencies, in other cases as well. We all know the infamous DLF housing society case where CCI ordered in favour of residents. Even the real estate bill draft calls for restraint on layout change without consent of its stake holders
It does not need the death of labourers but the initiative by leadership to get the justice. The same leadership is exhibited by SRS people . Lessons from SRS can not only be implemented across NEHARPAR but PAN INDIA

Great Efforts by SRS RWA. Thanks a lot to them and the GFWA Team who has achieved the biggest success in the form of teaching lesson to Piyush. The Builders and the local administration is in surprise and shock mode as they were taking the neharpar associations very lightly and were perhaps thinking that neharpar people are eating grass ?
The iron is hot now. We must not lose this oppurtunity and now is the turn of other associations to prove that they also have got the inner firepower like that of SRS and Piyush RWAs.
The BPTP , the KLJ....many more thugs in neharpar are also roaming free in neharpar with their looting spree. It is the turn now for their RWAs to act tougher. The BPTP Elite floor area has been increased beyond imagination. The KLJ Management is run by Goondas. KLJ charges interest on interest which is against law....The story is endless...
RWAs of other societies...get up and show your firepower now !

ideally court should have taken the case SUO MOTO after the collapse of school and DEATH OF LABOURS.
