I've got letter of possession with below demands, sent few questions to them on demands and no penalty adjustment.
I am not sure how many of us have already taken possession and if any one was successful in getting penalty adjusted for him( with little delay in payment demands).
if there is a group fight going on, on FCC charges, circle rate of 4000 and no penalty amount given, i want to join.

Dear Nitin,

Few points I want to highlight from your letter.

1. The Builder Group has not provided the possession in time and has unnecessarily delayed the possession for their own benefits (a. Allotees may surrender n they may sell at higher prices; b. for left out buyer, they may charge additional charges in many ways ( increase in area, cost, EDC charges etc c. Other interest).
2. They delay the construction and use that amount to start their new projects.
3. The terms and conditions of the agreement is on sided, biased to the Group.
4. Even if there are some conditions, which are in favor of customer, they do not obey the terms (like delayed possession etc).

There may be other factors as well, which I have not highlighted .

I believe all these conditions are well matched with the Group as well.

Secondly,

1. they have not provided the detail of increase in area ( the old plan and the new plan).
2. They have never seek our concern before increasing this area.
3. They have never previously informed that the project may be delayed by any time and have always demanded that the as per the plan the respective floor has been casted, hence make the payment.
4. The increase in cost should be counted in the initial costing of the plot, hence these high cost in the beginning itself.
5. They cannot merely increase the cost just giving a vague bill/demand.

Any discussion about the penalty for delayed possession. When we asked about the payment of penalty as per mention in the agreement, we were informed that it won't be paid as it will get adjusted against the 24% increase in the material and labour cost.
Also what are the huge demands at the time of possession, can I get some idea

What new demands are they making? I have come to know that they are demanding Rs.127.00 per sq.ft for fire fighting equipment.Additionally Rs.50000.00 is sought as advance for prepaid electricity meter. Additionally admin charges and few other charges are sought. Please verify.

There in no mention of adjustment of delay penalty in last demand letter.
ECC & FFC @ 127/- psf ?????

Great, now we have to pay the penalty for their delay. If we delay we pay penalty, if they delay then too we pay the penalty. How unfair and ludicrous is that? Is there no justice in this land? First wait for 4-5 years delay in possession while you pay your rent as well as bank EMI, even today we don't know when we will get possession - 2016? 2017? but what we know for sure is that we won't get the contracted penalty for delay for which the builder is responsible. WHY DON"T WE(RPS BUYERS) GET TOGETHER AND PUT THEM BEHIND BARS LIKE THEY HAVE DONE TO PIYUSH GROUP OWNERS?

Justice will be delivered only if you fight. It is not too late now, you can get together and file a case in the consumer court. Only if you start now, expect some relief after 2-3 years from the court. But you have to start now and take the lead, otherwise pay the illegal demands and be at the mercy of the builder.
