Hi All,

Good to see, we are getting together to counter this unjustified hike in EDC. However, the million dollar question is how many of us plan to pay this if we don't manage to get the stay order on this by say 20th August. I think we should take unanimous decision either to pay or not to pay.

Please go through the notification issued by HUDA to TCP, Chandidarh which was issued to builders later asking for deposit of extra EDC. From it, it is very clear that if builders do not pay EDC to HUDA, DTCP / HUDA will not issue completion certificate to builders means further delay of some more years. EDC can not be deposited by us only if court issues stay order. But how much time it will take we are not clear yet. Just waiting for the response from GFWA - requested to update.

Following things should be very clear:
* Builders will charge interest after due date in case we are not depositing EDC within time
* In most of the agreement, they have power to cancel allotment after one/ few month/s in case we do not deposit the EDC after issue of demand letter by the builder
* If we will study the agreement in detail, we will find that we even do not have power to get the late penalty as many builders have given many terms and condition in the agreement while defining definition of late possession. Until it is clearly mentioned that after this period, their project will be called as delayed.

So now it is open for the discussion whether we have to deposit EDC or not.

What is the opinion of GFWA organising committee on the increased EDC letters coming from many builders ? any positive news on the stay order front ?

If we all take a unanimous decision of not paying the increased EDC at this stage till some progress is visible and the flats are handed over for possession, no one can harm us.The time has now come to take these decisions.

Seema Ji,

In more ways than one, this PIL against authorities could be the make or break of the morale of the GFWA community. I pray and wish that it happens soon. Words are insufficient to praise the efforts of the core team members who have managed to create GFWA and bring it this far. May the fair get its due.

I have one question... As per the initial plan the posession should have been given in 2009 year end and this additional EDC charges has been declared in August 2011 then how come we are liable to pay this amount.. If We could have got the posession in 2009 or 2010 even then in that case also should they ask for EDC charges..if NOT then these EDC charges needs to be bear by the builder not us.
Please comment..and act accordingly...

Maybe we should take photographs (or video) of the filth and broken roads, the water rotting besides the roads, the dirty canals, the incomplete work of almost all the builders, and show it to concerned authorities (the development minister of Faridabad) and ask them why should we pay for the increase when everyone is behind schedule, its not our fault so why should we bear the cost. It will be also be good argument / proof of any future legal action. If we are going to arrange a meeting in that area I can bring a camera.

The Kisans of Faridabad are meeting in Bhatta Parsol on 7th August for giving air to the fiery thought of increase in compensation to Rs 3 crore per acre from Rs 42 lacs as recd by them from Government. The media will also reach there and it is cerytainly going to become a issue. ( Though the flat owners are safe in Faridabad as the builders have directly purchased land from farmers at the market rates only ) It will affect the works of the governments for Master Roads and other related infrastructure. And as usual, the government will loot us more to compensate the kisans. There will be another increase in EDC and IDC. We need to stop the government to loot us any more. Request the GFWA concerned committee members to make all out efforts to get a stay on increased EDC. This is the only way left for us otherwise we are going to be squeezed very hard by this government who has been sleeping till date when there was need to complete all the works for development.

Right to say , but all flat holders are not attached with forum . how is this possible ? As far as I know that some of the flat owner from SPR has already paid the increased EDC as they were not attached with forum.

Hi Friends,

Will someone ask these authorities, who have all of a sudden decided to increase the EDC IDC charges that how will a common person who couldn't afford a house in Delhi, Gurgaon and had to invest in an undeveloped area to secure a home for himself in future, afford lakhs of rupees payment so quickly.

???

Hi All Savana Members,

Please do not be sentimental with this demand letter received by all of us for increase in EDC charges, all of us knew it - this will happen one day but the date was not known to us. This has already communicated by other builders to their customer such as BPTP, SRS, Omaxe etc..

When we had series of meeting with DTP Sanjeev Mann and Mr. Srinivas (I hope I got it name right), they told us the EDC for Faridabad was not yet fixed and is expected to come very soon.

There was public notice published by HUDA in Hindustan-Times_Main-Pg-16 and the very same was uploaded by Ajay Yadav on June 10. Please follow the link below

Moreover, the amount of EDC will go directly to HUDA and not to RPS, the only concern here will be how RPS has reached to this amount of Rs 131/- per sq ft and this will be the matter of concern.

An interesting read from the SURGE website who filed the PIL on the EDC Charges of Gurgaon.

But this case is still going on for last so many years.

My gut feeling is that even if we file an PIL which we will surely do, there will not be immediate relief for all us before end of Aug which will be deadline to pay EDC charges to RPS.

And if we do not pay the EDC charges, RPS will put penalty on us @18% till we pay, and moreover their may be case that the late penalty charges may be denied citing this reason that your payments did not came within defined timeframe. This I am saying because the way words are choosen while writting the letter by RPS is very legal in nature and will take thousand of things to consider.

Since we are all waiting for almost 5 years to get our home sweet home, calculating penality from jan2009 (optimistic date which RPS does not agree) till Dec 11 will come around 150,000 (approx), so no one wishes to lose this amount.

Please do not take me wrong or very conservative but at least give this a thought and lets discuss it more.
Another interesting point is HUDA as reduced the EDC charges in GURGAON sometime back (not sure about the date and month). So why HUDA is discriminating against two cities of own area.

I believe we should have demonstration against HUDA for this increase at last week of Aug, so that we can prepare for this demonstration.

Hi Sanjeev/Savana Members,

Updates from GFWA legal team:

1. SURGE of Gurgaon is supporting GFWA. We have been in touch with them for more than 1 month.

2. We are NOT filing PIL, but we are filing WRIT to rollback Govt. decision. WRIT provides very quick relief. Farmers in UP also used WRIT to protect their rights and you can see tremendous impact in NOIDA extension.

3. If Govt. decision is rolled back, then demand of RPS or for that matter any builder, becomes NULL and VOID. In that case, clause for not giving penalty amount will not apply.

4. Demonstration against HUDA/DTCP does NOT work as we have learned from past.

the enhanced EDC is not applicable on the license issued before 2004. However it is applicable for the license issued after 2004. Please see the HUDA notification carefully.
