Minutes of Meeting with Shiv Sai Management - 03/12/2011

Hello all,

Following are the MoM held on 03.12.2011 at Ozone Park with Shiv Sai management.

Ozone Park Investors: Mr Rajat Bhatia, Mr. Nicket Gera, Mr. Puneet Bhatia, Mr. Arun Shah, Mr. Mukesh Agarwal, Mr. Surinder Mittal, Mr. Ajay, Mr. Lalit , Mr. Avinas Nigam, Mr Ranjeeb, Mr. Prateek Pandey,Mr. Kapil,Mr. Srimant, Mr. Aditya, Mr. Biju,Mr. R.K Gupta,Mr. Nitin,Mr. Deepak, Mr.Anupam,Mr. Satyajit,Mr. R.V Singh,Mr. Rajandrav,Mr. Alok,Mr Vineet, Mr. Sachin,Mr. Pankaj,Mr. Viram and others ( Approx. 45-50 Ozone Investors).


    · Shiv Sai (Mr. Sandeep Gupta) to revert back, before 10.12.2011, with the final Possession Dates for all towers ( Except Tower 8 & 9).
    · Shiv Sai to share the detailed ''Per Sq Ft'' calculation of the Enhanced EDC charged to customers.
    · Shiv sai has confirmed that they have got all necessary approvals to get complete electricity load from DHVB. Electricity line laying would be done within a month.
    · Shiv Sai to consider the following issues applicable to all towers/apartments :
      - The windows frame in the main drawing room is made from wood and have no protection from rains, which will damage the wood in rainy seasons. This is a serious concern as it may also cause the glass to come out of the window frame. Shiv Sai can install a plastic window canopy over the window which will serve the purpose.
      - Shiv Sai to check if the kitchen door is installed correctly and would not cause any issues in opening of refrigerator or day to day working.
      - Shi Sai management would address and resolve individual complain in case any owner has issues with his units.

    · Any tentative timeline of possession of Tower 8 and Tower 9.
    · There would be construction activity which will get started where we have the sample flat, but the labour entry / exit would be separate and it would not impact the resident of Ozone park.
    · Club and other construction are expected to get completed by same May – June time period
    · Shiv Sai would install Gen-set in tranches based on occupancy. The first one is expected in Jan’12.
    · Shiv Sai would hand over the keys of individual units before the date of possession in case the buyers want to start their individual wood work etc.


Above were the main discussion points. Shiv Sai management will revert with the final possession dates as well as EDC calculation, which will be shared with everyone.

Hi Rajat,

Thanks for putting the meeting together. Have you any update from Shiv Sai ?

Kindly post the reply in same thread mail , so all can see the reply without troubling you.

Also request Shiv Sai to take up work in T8 & T9 , as and when activity in other towers is completed.

Hi all.

Below is the response we have received from Shiv Sai.

Dear Customers,

We all are happy to note that meeting between the Management (Project team) and the Customers was held on 3rd Dec 2011 in a friendly and cordial atmosphere.

Queries raised by you in the meeting are discussed as below with our comments to the point:

1) Occupancy will be offered any time between 28th Feb 2012 to 30th April, 2012, with or without Tower 8 & 9.

2) Regarding the calculation of EDC, we would submit that the matter being sub-judice will be shared with the customers as and when judicial out come is made known. We again emphasize that the customers who have not paid the same yet should pay the due amount as it may affect or delay the occupancy further.

3) Regarding the points of changes required in apartments / towers the position is as below:

(i) As regards the shade/protection outside the window in dining area, we have asked the Architects to suggest if it is possible to add the same looking at the fact that the occupancy can not be delayed. We will look into the option as to how the same can be executed.

(ii) Kitchen door can’t be changed as the rebate is already cut inside and the door will have to remain there.

(iii) Individual complaints if any will be taken care of.

4) Possession of Towers 8 & 9 will be tried to be given by 30th April, 2012 or latest by 30th June, 2012.

5) Construction / finishing activity may take place even after occupancy as this is an ongoing process. You may please appreciate that the work in a township is an ongoing process which may necessitate in case of residents’ own flats/apartments as well. We will all have to ensure that we should avoid troubling the residents & minimize disturbances.

Here is our response to Shiv Sai mail...

Dear Mr. Sandeep Gupta / Mr. Vikram Dhawan

    As discussed during the meeting on 03.12.2011, Shiv Sai Management (Mr. Sandeep Gupta) agreed to share a final date of possession. The date range given in your response i.e. 28th Feb'12 to 30 April'12, can be anybody's guess. Considering Shiv Sai stand that work in most of the towers is complete and only occupancy certificates are required from Govt. we would request you to share a practical date to which the investors can agree.

    We agree that the enhanced EDC matter is sub-judice but that did not stop Shiv Sai to ask for payments from investors. Hence, the investor has the basic right to know the mathematics behind the enhanced EDC calculation before the payment is made. More so when tt was also agreed during our meeting with Shiv Sai on 03.12.2011 and was agreed by Shiv Sai. We are hopeful that the calculation of enhanced EDC will be made available to all the customers.

    Please let us know the alternative for the Kitchen Door issue. I hope, Shiv Sai does not expect the customers to "live" with this error/mistake for their complete life.

I have paid enhanched EDC but i don't know when the builder SHIV SAI will gave possession .
