Minutes of Meeting with Chief Engineer, HUDA, Panchkula on 18-Feb-12

GFWA Members met Chief Engineer, HUDA at Panchkula head office at Chandigarh.

Here are minutes of meeting:

1. Tender for master roads construction is open and process of allocation is in final stages. He informed also some reputed company in infrastucture for grant of tender.

2. Master roads length acquired by HUDA is ONLY 29 kms and rest of master road length is stuck because of complex litigation by farmers. Also, he told that farmers are not vacating land of HUDA in sectors 75 and 80.

3. HUDA will NOT construct sector roads. Sectors roads construction will be responsibility of private colonizers

4. ONLY 1 additional bridge (as against 4 additional bridges required) across canal is in final stages by HUDA Chief office. He directly informed that if you want more bridges, then exert pressure on local authorities in Faridabad

5. There is no plan under consideration by HUDA for connectivity to NOIDA. He told categorically that there is NO plan of connecticity to NOIDA and what builders are telling are lies. Also, again he directed that if you want connectivity to NOIDA, then exert pressure on local authorities in Faridabad

6. Development works by HUDA for acquired land by HUDA will be completed by Dec 2014 (affidavit has been submitted by HUDA to High Court)

7. Some of EDC services like Sewerage, Storm Water are under consideration by HUDA and will be taken up. He again pointed to complex litigation which is hampering these services. For Storm Water, he told that there can be Phase 2 of this as first phase may not be able to meet up demands

8. HUDA does not intend to provide drinking water services. Builders have to provide water by tubewells

9. He appreciated idea for Metro in Greater Faridabad. He again told to exert pressure on local authorities in Faridabad and he will support from head office.

10. For unauthorized and illegal constructions, he directed us to contact Deputy Commissioner of Faridabad.

Meeting ended with a good note and he thanked us for coming to Panchkula as it really helps to keep Greater Faridabad development issues on priority.

I'd appreciate if you could provide any update regarding EDC/IDC Issue??

I would like to express my thanks to various volunteers - Anubhav S., Shatrunjaya, Amit, Sachet,Kulbhushan, Anindya, Anubhav K, & our working committee members Umeshji, Rajanji & Dheeraj, who willingly spared entire day for a general cause, participated in various meetings, and helped in raising alarm bells in Chandigarh. Hopefully the administration wakes up soon & start with real ground work.

To have official focus on interest & concerns of home buyers toward development is going to be a long drawn battle, and will required sustained efforts, Lets hope the effort pays off.

Dears,

Thanks a lot for putting great effort for Greater Faridabad. We really appreciate your efforts.

By reading the minutes of meeting we can figure out only one thing one officer is passing his responsibilities to other officer. A typical way of working of Government Officials.

If we really wanted to see a better Greater Faridabad then we really have to put more pressure on each and every officer which have got the power to do the work. There are so many work which are pending from the last 5 years since the Greater Faridabad has declared a Residential Zone. Nothing has happened in the last 5 Years and most of the flat owners have already paid their EDC charges to the Haryana Government. Then what is the reason the local administration has done nothing in the last five years. What Haryana Government is doing with that money that they have take from us for the development of the area?

1. Master Roads and Sector Roads are not built.[/b] We should get the confirmation by when we can expect the completion of the same.
2. Pathetic Transportation Facility. As of now transportation is the biggest problem for the people who are residing in Greater Faridabad. Only transport facility is available that is Shared Auto and you can not avail this facility at all if you are traveling along with your family. It's not safe for the families and you don't have any other option for your family except you use your own vehicle. In the absence of your vehicle you just can't go anywhere with your family. That kind of pathetic transport facility we have in this area.
3. Bridges are not completed. Kheri Pul should be completed on top priority because that is the main entry point to enter the most of the Sectors in Greater Faridabad
4. Lighting of Roads.
5. Sewage Treatment Plant
6. Appropriate supply of Water and Electricity. As of now it's very poor.
7. Cleanliness of the Area. At the moment the neharpar area looks very dirty because of lack of cleanliness. If needed we should start any initiative to make this place more greener, more cleaner and better. At the same time we should also press the local authorities to do their work promptly.

Unless and until the above 7 tasks not completed till then we can never called a Greater Faridabad a better place to live. We should not relaxed at this point of time otherwise this work will take another 5-7 years to get completed the way these officials are working.

We should find out the reasons why the above work is not completed as yet. There should be guidelines and time framework to complete all above tasks? If somebody is not doing their work then we should put more pressure on them to do their work on time. If needed, we should file an RTI to get the explanations from them and if the explanations are not justified then file a case against all those officials because of them the above work get effected.

This is my opinion. You guys are more capable and knowledgeable.

From the clarification of the Chief Engineer, HUDA it seems that except construction of so called Master Road (that too only 29 KMs now), all other ressponsibilities, like construciton of Sector Roads, providing electricity, drinking wather, etc. are of the concerned Private Builiders. So, where is the justification of charging such a huge amount in the name of EDC that too well in advance and also with severe penalty clause for construction of only 29 KMs road?

Another excellent attempt by GFWA in the larger interest of the common Home seeker currently reeling under the widespread public apathy caused by the administration and builders.

Going through the minutes, I would like to take point no 3 of interest specifically. From what I understand that the sector roads have to be brought into shape by the builders and the largest being BPTP who holds onus for underdevelopment of the neharpar area along with violation of many licencing conditions.

Wish to draw attention of core team and legal experts with the Association to the particular aspect of development of sector roads which are a part of the licencing agreement as understood from the specific portion of the ACT

" Cost of Development Works.—

(1)The colonizer shall deposit thirty per centum of the amount released, from time to time, by him, from the plot-holders within a period of ten days of its realization in a separate account to be maintained in a scheduled bank. This amount shall only be utilized by him towards meeting the cost of internal development works in the colony. After the internal development works of the colony have been completed to the satisfaction of the Director, the colonizer shall be at liberty to withdraw the balance amount. The remaining seventy per centum of the said amount shall be deemed to have been retained by the colonizer, inter-alia, to meet the cost of land and external development works.

(2) the colonizer shall maintain accounts of the amount kept in the scheduled bank, in such manner as may be prescribed:
provided that where the license under section 3 is granted for setting up a colony for cyber city or cyber park purposes, the provisions of sub-sections (1) and (2) shall not be applicable."


As it appears from the current progress on the ground level, within the BPTP township, hardly any work has been completed that can get them the occupancy certificate or part/full completion certificate. STP and internal electrical distribution set up is yet to be initiated..Possibly water lines and sewerage lines are in place but unconfirmed.

Can GFWA as an association file relevant RTIs to ascertain the finding of audit on the Internal Development Work, under the meaning and purpose as mentioned in the extract of the act reproduced here?? This is necessary as all the projects have paid more than 95% of the money for the Construction Linked Plan towards the township. The Time elapsed since this payment has been considerable by any measure of reasoning. Also this has nothing to do with the Master Road tenders or the NIT towards construction of master sewerage as evident form point no 3 encapsulated in the minutes.
