Almost everyone would have heard on FM radio or in newspaper statements made by Sunil Dahiya of Vigneshwara developers talking about innovation in real estate and luring people for making investments. Same Sunil Dahiya has been arrested by Economic Offense Wing of Delhi for duping investors of Rs 160 crores.

Delhi: Top builder held for 'duping' investors

A director of Vigneshwara Developers Private Limited was arrested by the Delhi Police’s Economic Offences Wing on Friday for allegedly duping investors of Rs. 160 crore.

Sunil Dahiya, according to the EOW, was wanted for failing to deliver on two residential projects in Gurgaon for which his company accepted immovable property as payment for proposed housing units.

He had been trying to evade arrest for a while and was reportedly trying to flee to Chandigarh when the police, acting on a tip-off, caught up with him in south Delhi’s Sunder Nagar.

Police sources said Dahiya had been staying at various five-star hotels in the city to avoid being tracked.

Three cases had been registered in connection with the two projects launched by Vigneshwara Developers Private Limited —which has a presence across north India — and its group companies in Gurgaon’s Manesar and Sector 74.

“Approximately 700 investors invested in these projects. We received complaints from nearly 350 of them alleging they have been cheated to the tune of `160 crore by the directors of the company,” DCP (EOW) Mangesh Kashyap said.

“The company’s directors (Sunil Dahiya, Sanjay Dahiya and Daryao Singh) made unrealistic promises to the public regarding the projects… and lured them to invest. However, the company did not have all the approvals required for the projects,” he added.

The DCP said eight mobile phones, an iPod, laptop, various credit and debit cards and other documents were recovered from Dahiya. His BMW — bought in 2013 and registered in the name of Vigneshwara Developers — was also seized.

Attempts by HT to contact Dahiya’s lawyer failed.

It is good sign that lots of such names are coming out in open, several of builders are getting punished by CCI, EOW, & courts. I sincerely hope and pray that agencies gets active in more such complaints, perform due investigations, instead of closing most builder related frauds simply as civil case, and lots more such corrupt builders face harshest punishment possible.

And to the people, though fighting against builder mal-practices is time consuming & frustrating at times, but it is worth every moment. DON'T ALLOW ANYONE TO CHEAT YOU, atleast give in a tough fight.

We have been fighting against the builder since 1 year and the process was initiated as follows:

When we came to know that the builder who sold us dwelling unit does not hold license and title of land we went to the Commissioner of Police, Faridabad to report the matter to him. He was reluctant to hold any enquiry and forwarded our matter to the EOW, Fardiabad. EOW recorded our statements and thereby kept silent. On follow up we were told that the outcome has been sent to the O/o Commissioner of Police.

We then filed a complaint u/s 156(3) with Magitrate, Faridabad. The complaint was taken up by the Ld. Magistrate and statements from o/o DGTCP, Chandigarh and Faridabad was recorded. Both, DGTCP Chandigarh and Faridabad recorded that the activity is illegal. Subsequently, Ld. Magistrate summoned the Directors/Officers to face trail.

On receipt of Summons the Builder applied for Anticipatory Bail in the Sessions Court, Faridabad and the same was rejected by Sessions Court. Thereafter, the builder applied for Anticipatory bail in the High Court, Chandigarh and was allowed after furnishing Bail Bonds and were asked by HC to Appear before the Trail Court on every date and not to hinder the process of Trial.

Thereafter, the builder applied for revision in the Sessions Court, Faridabad and the revision has been accpeted on the grounds that the Company is not made a party and no specific alligations have been made against the accused Directors and Officers. Apart from this the Sessions Court has heavily relied on an UNREGISTERES development rights agreement, on a 100 rupee non judicial stamp paper, between the Builder and Countrywide who is the holder of license and title of land.

Now we are planning to appeal before HC, Chandigarh and solicit any help vide legal advise or otherwise from anyone concerned.

We would be gald to share the detaied copies of all the related complaints/orders etc.

Delhi flat owners take to the streets

A large number of people holding flats in twin residential projects of Triveni Infrastructure Limited at Sector 78 and 89 in neighbouring Faridabad staged a protest at Jantar Mantar here on Sunday against delay in possession of flats.

The protesters gathered outside the Patel Chowk metro station around 10:30 a.m. and marched peacefully towards the residence of Union Home Minister Rajnath Singh to submit a memorandum.

“We were stopped by the police from marching further near the Air India office on Ashoka Road. We were asked to send only five representatives to meet Mr. Singh. We met his personal secretary as he was not available. We met him at the office and apprised him about our grievances, which he listened to patiently. He then asked to get back to him on Monday for an appointment with Mr. Singh. He asked us to personally submit our memorandum to the Mr. Singh,” said D. Venkatasubramanian, who heads the media cell of Triveni Faridabad Allottees Association.

The flat holders then held a protest meeting at Jantar Mantar and shared their grievances.

Failed promise
“The developer had launched the projects in 2006 and booked flats and received Rs.1,000 crore from more than 5,000 families on the pretext of allotment of the projects with a promise to deliver the flats within three years. Though eight years have gone by, not a single falt has been delivered. They resorted to threatening and intimidating customers, registering fake FIRs when customers stood up for their rights,” said TFAA president Saurabh Saraswat.
