A Buyer in BPTP Sector 76,PF2, filed a complaint to STP Fbd regarding illegal possession being granted to buyers in PF2 and the Reply from STP is enclosed.

Dear Park Floor II owners ,

do we keep waiting for BPTP to get OC ? we continue to pay EMIs and rent while a ready flat cannot be occupied for no fault of ours.

is resale happening? approx prices?

1. A Complaint application to be forward immediately to District Commissioner with copy of PMO Office, CMO Office & STP Office.

2. A Legal Case to be file with Consumer Forum immediately without delay with all compensation around 20-30 lacs (Compensation format enclosed).

3. Followup Application submitted to DC .

4. After 15 days FIR Against BPTP for illegal possession.

This is the reply from STP to complaint from a Buyer about illegal possession by BPTP in PF2,Sector 76, where almost 72 Families are living, with illegal registries.

I was long awaiting for this document.

With this document, It is beyond doubt that what PIYUSH did and what many other builders are doing, is nothing but illegal practices under cartelization. By Illegal "Offer of Possessions, without OC" under various garbs are nothing more than force feeding buyers with Alphabet soup rife with toxic illegalities.

They continue to loot and harass buyers, assuming that he cant deny as he is already suffering with delays and burdened by EMIs and Insecurity of HOME. He but has no other choice to make than to accept the illegal, "Offer for fitment", " Offer for Completion", "Final Demand for Fitment" all tagged with illegal and unethical demands followed by Maintenance Charges.

For those accepting such offers, please don't think that the matter gets brushed under the carpet, the bulge still remains and hits when events like Campa Cola occur. This could happen and you may trip on this bulge, apart from paying huge maintenance and insecurity of living in an illegal home.

Please count me in for contribution to any legal action against BPTP on this and every other illegality by it.

Thanks once again for such a valuable document, clearly mentioning that a builder cannot
- Offer possession without Occupation Certificate
- Illegally charge Maintenance without Occupation Certificate.

Please attach compensation form.

BPTP is trying to fraud by all means. Please INDIVIDUALLY File complaint
1. GOVT Customer care
2. File RTI To get all kind of Information from Govt department against BPTP and POST on Blogs/Consumer forums
3. Write to Govt Bodies

Govt will be force to take action, but there HAS TO BE Flood of complaints in legally capable authorities.

Dear Park Floor II owners,

Its been 6 years since we booked. Still no OC , no legal possession as we keep on paying EMIs.

Is there any news on the OC front. Is resale happening. Kindly share your info /views as to what should investors do?

Meeting on Feb. 22, 2015 (Sunday) at 11 am (Era Divine Court Site, Sec-76, Faridabad)

Dear Friends of Park Floor II,

As we all know that Era Divine Court Project has been in doldrums since long due pathetic attitude of Adel (Era) Landmarks Ltd. Most of Low rise flat owners have booked in 2009 and High Rise owners Later. It is more than 5 years and company has done little to legalise the project.

But as you may be aware of fact that 12+1 people filed case in Chandigarh High Court for regularization of the project and got a favourable decision. In our petition, we have made BPTP as the main party, as they are the original land and license holder of the project. Due to ongoing dispute regarding payment between BPTP and Era, not only Era Divine Court Project got stuck, but Park Floor-II project also entangled. Now both projects are in limbo.

But owing to the decision of High Court and aggressive stand taken by us, BPTP and Era have come to talking table with DGTCP and the Petitioners. We (BPTP, Era and Petitioners) have TWO VERY SUCCESSFUL MEETINGS with DGTCP in Chandigarh. Earlier, Era was not interested in any kind of negotiations with BPTP and us but now they are talking.

But to get the projects regularised at the earliest, we need support of all, not one or two people. We have got some favourable decisions. There are many useful information to share with all the allottees regarding regularization of the project. For this we have called a meeting on Feb. 22, 2015 at 11 AM. The venue of the meeting is Era Divine Court Site, Sec 76 Faridabad.

We request everyone including ALLOTTEES FROM PARK FLOOR II to come there and formulate a plan for early approval of both the project. This is a time of final thrust and we need support from everyone. Please be the part of the movement. You would be helping yourself by coming there.

Looking forwards to see you all on Feb. 22, 2015.

Resorts received the oc long back . Can anyone please update on the OC status of Park floors 2. seems we are caught up in a real mess! what about the licence of BPTP? :@

Builder firm MD, 2 officials named in FIR

GURGAON: Based on a complaint from the Chief Minister's Window, an FIR has been lodged against the MD and two other officials of BPTP builders for allegedly cheating a city resident out of Rs 25 lakh for booking a flat in a BPTP society in Sector 57.

According to police, Sanjay Gupta from Jacobpura colony near Sadar Bazaar, Gurgaon, lodged a complaint with the CM Window, stating he got the allotment letter in 2006. Gupta alleged he had paid Rs 25 lakh through demand draft and cheques but eventually he neither got the flat nor his money.

He approached the CM window after waiting for many years for justice, the complainant said.

After receiving complaint from CM window, Sector 56 police have lodged an FIR against BPTP's managing director Kabul Chawla, one Anish Nanda, and customer care in-charge Ritika have been booked under sections 420 and 406 of the Indian Penal Code. "The investigation is going on," said ASI Prem Singh, the investigating officer.

BPTP's comments could not be obtained despite repeated attemptsand repeated attempts by TOI to get one from the company proved futile.
