Why should we fight for common area ?

Many of us have this feeling that green/open areas are secondary things, and can be kept at backend. "Pehle ghar ki chabi mil jaye , greenry baad ki baat hai"

We all agree that our priority is to have the possession, I want to highlight the reasons why the other issue is equally important -

In principle if we paid for an apartment with 80% greenery, we should receive one, However many things do not go by principle, Here are the other reasons we need to fight for this land

Savana Township is going to host 2200 + apartments, Similarly Piyush will have 1100 apartments, there is huge effort and running cost that would be required for maintaining such a big township, and in all probability builder is going to charge you anywhere between 2000-4000 per month for maintaining the premises. So we would be required to pay him anywhere 25 - 50 K additional cost on an yearly basis for maintaining the township.

As happened in DLF case, The builder will open the amenities like swimming pool, club etc for outsiders as well getting additional profits and, in addition denying us exclusive access to the amenities. Even if we are ready to share, The money which should go in RWA, will eventually go in the pockets of builders.

As per rule of land, and our discussion with President, "Association of Apartment Owners", the township should to be able to generate funds on own, We cannot generate funds from the staircase, pumphouse, escalators,etc. The money has to come from the leasing of commercial areas which include - shops, schools etc, and as per Haryana Apartment Act, this land belong to all of us,

Hence construction of these structures is one aspect, Other equally important factor is whom does these structures belong to. Fighting for this cause may also ease us on some amount of monthly maintenance charges we would be required to pay at later stage.

Sorry to say but I do believe in ' Taking first step first and think about second step later'. So, there will not be any question of monthly/yearly maintenance payments if we do not get possession at all !! So, fight for the possession first and rest of the things we can sort out later. Once we are the legal owners of our flats, we will have many more rights to fight for the deficiencies in delivered project.

1.Regarding common area, I will like to give example of China. China also constructs 18 storey towers for its labour class with very little open spaces and green area. Difference here is that those flats are sold very cheap or sometimes free.

THINK what you had been promised and now what it has become now?

2. Regarding fghting builders after getting possession, that is almost impossible. If you read carefully buyers' agreement, it explicity states that buyer when receives possession gives an undertaking that all things in project are good and in working condition. Law also states the same that builder's role is to construct, deliver and then exit.

3. Regarding MEDIA, people think that getting media coverage is child's play. Reality is exactly the opposite. Media verifies story and also sees how many people are involved? If 100 people protest, I can guarantee media coverage. But realily is that despite our best efforts, only 15 people come at builders office and rest sit in their AC offices.

4. People say builder will delay. Whether you go to court or not go, builder will only go by his commercial interests. We did not go to court for 4 years. Has the builder delivered ?

So, please be united and gear up for legal action. After all Courts and Police run on our money that we give as Tax.
