Rule 17 Of Haryana development & Regulation of Urban Areas Act 1976 States that License can be transferred.

I really appreciate posts by Mr. Amit Sudan, Flat-Deals.com and Dr. Naveen. In my opinion, even though illegality may have occured, but that was/is in full knowledge of DTCP, Administration, Banks who gave loans etc.Common buyer when buying a residential unit checks for these things and they seem OK. Now, because of larger criminal design and conspiracy by crooks like Triveni, common buyer should not lose their residential units. In NOIDA extension, there were illegal and criminal activities done by Govt. of UP by buying land from farmers for Industrial Purposes, then changing title of land to residential and then selling out to builders. Legally, all projects should have been scrapped. But, Honorable Supreme Court while looking at interest of thousands of families loosing their homes decided not to scrap projects. Same thing can be pleaded by buyers of sub-licenced projects of Triveni in Honorable High Curt of Delhi.

I think we should prepare a list of Housing projects that are being built by Builders other than the licensee, so that every body knows what is the real modus oparandi of these builders and to what level the Authorities deliberately violate the Law;s which they are supposed to Protect and execute on ground, so that they can be exposed.

Ferrous project is also under triveni license.

All the builders, collaborators in the Triveni case are roaming scot free, despite more than 4 dozen FIRs in Faridabad against Ex-TIDCO management, all of which Court ordered to File FIR under section 156(3).

Whole procedure of 156(3) of Cr.PC is mention below:
1. file the complaint before court u/s 156 (3) of Crpc.
2. The court issue notice to Police station and demand status report that there is any case related to this matter in police station or not.
3. after getting status report and if police says that there is no FIR then the court record the statement of complainant and witnesses on oath and after that if the court think that there is a prima facia case has been made out then direct to police to registered a case and complete investigation.
4. One copy of this order sent to police station without delay and the SHO of the police station registered the case.

Similar Projects Like Zion are:-

RPS Auria on Achievers License 124 of 2008
Puri anand Villa other Puri Poject in Sector 81 at Countrywide License
Era divine Court at Sector 81 at Countrywide License in Sector 76.

These clearly are illegal projects which violet the basic law of HRD Act 1975.

Whoever posts similar project details, please be very clear on facts. Triveni i.e TIDCO is one company and Ferrous is separate company now. Both originally were a joint venture called Triveni Ferrous Infrastructure TFI. Its Triveni and related projects which are in key issue here. Ferrous I think other than license issue (i.e license not in their name which in name of parent company TFI) is not related to this POA issue, as is not under Triveni now.

Dears,

The license was issued to Triveni Ferrous and Triveni Infrastructure for 48 acre in Sector 89 and 38 acre in sector 78 but now since the matter in Delhi High Court and the court have already appointed a official liquidator for the sale of land then this entire land will be sold because of HDR Act the license cannot be split. So that mean the Triveni will be the sole owner of the land despite they have created the 3rd Party Right without prior permission from DTCP and the agreement between the triveni and these builders will be considered null and void as per supreme court rulings. In the absence of conveyance deed.

So that mean all the flat owners other than triveni will also become the part of this land sale as decided by the H,able High Court. I would recommend all the flat owners should seek the legal opinion on this without wasting any time to safe guard their money. This matter has become a very complexed and it has to be dealt legally.

The time has come for everyone to stand up and take the stock of the situation and act accordingly. Get all the information and go to the bottom of this otherwise it will be too late.
