The matter is listed on 11th November 2014 before Justice Rajive Bhalla and Justice Amit Rawal in court room number SIX(6) and is listed at Sr Number 202.

Friends,
I regret for not being present in the court today on 11th November 2014 as Justice Rajiv Bhalla went on to hear the argument on the said matter. The Sr Advocate Sh Sumit Mahajan had an argument for one hour and got stuck at various arguments and started looking back in the complainants lobby. After he found none in the audience lobby Advocate Sumit Mahajan looked furious in the absence of inputs from the complainants.
Even advocate Sumit Mahajan could not assert on the ingredients of EDC. After seeing Advocate confused Justice Rajiv Bhalla directed HUDA to submit a fresh affidavit within three weeks with regard to the amount collected v/s expenditure on the constitutes of EDC ONLY and also scribble the constituents/ingredients of EDC.
Unfortunately Advocate Rajiv Atma Ram ji was not present during the argument.
Justice Rajiv Bhalla has been into the said case earlier also in the year 2011.

Now the next date of hearing is fixed on 04.12.2014.

Positive side is that arguments started after many dates. I will try to visit Chandigarh on 8-Dec-14 for hearing

Dear Friends,

Since I was in Mumbai yesterday so I also could not attend the hearing. However, as I am informed by Mr. Sumeet Mahajan yesterday evening over phone, he was not confused but surprised on (i) some mis-statements by Govt. side on EDC collection and its utilisation, as the said statements were not part of record and even were not in the affidavit filed by Huda on previous occasion (ii) HUDA was justifying their affidavit filed on last occasion, which covers external development work of other areas in Faridabad other than Sec-75 to 89. Mr. Mahajan argued that if EDC is collected from me then it has to be utilised in Sec-75 to 89 only and not in other areas as stated by HUDA in their previous affidavit. The detailed arguments were heard in the matter and accordingly all these mis-statements were duly countered by Mr. Mahajan as a defence on merit of the case.

Accordingly the Hon'ble Court was pleased to direct HUDA to file a fresh affidavit stating current status of EDC collected so far (including old EDC), development work executed so far and expenditure incurred so far from EDC collected only in respect Sec-75 to 89 Greater Faridabad.

If HUDA files this fresh affidavit giving all the above details/ particulars, I am hopeful we will be able to counter them more forcefully as they cannot justify the external development work against EDC collected so far. As per HUDA's own affidavits and discloser in court on previous occasions, the old EDC collected so far is much more than expenses incurred or total expenses required to be incurred on external development work in Greater Faridabad.

Dear all senior members,

Please avoid personal differences as being reflected in various previous posts. Recent posts regarding hearing in Court create ambiguity.

Members including me, who are not devoting any time/effort, appreciate your hard work and efforts in this matter.

Please set aside differences, if any, for the sake of common cause affecting thousands of buyers who have put in their hard earned money in various projects Sector-75-89 Faridabad. We are looking forward to positive outcome in this case.

1.Affidavits submitted by HUDA( Faridabad) and DGTCP.
2. Affidavits taken on record.
3. Next date of hearing is on 09.02.2015.
