Complaint/Grievances against OMAXE HEIGHTS, Sector 86

BACKGROUND

-Rs 6 Lacs paid to OMAXE by cheque till 23 Apr 2006.
-Draw of lots held on 14 Oct 2006 for 630 Flats->3BHK and 1068 Flats->2BHK.
-Project formally launched on 13 Nov 2006, advertised in all leading national dailies.
-Project was to be completed within maximum 36 months.

- False promises

Tentative possesion date by Jan 2010 as told by Omaxe Customer care in Sep 2009.
Tentative possesion date by June 2010 when enquired in Feb 2010.
Tentative possesion date by July 2010 when enquired in Mar 2010.
Tentative possesion date by Sep 2010 when enquired in May 2010.
Tentative possesion date by Dec 2010 when enquired in Aug 2010.

On personal visit to the site on 01 Mar 2011, It is now being told that the possesion is
likely to be given out for 3 BHK flats after 8-10 months for Oscar tower.

There is no reply from the customer care to the mails sent in feb 2011 and thereafter.

- Payment details

95% of the basic cost and 100% of EDC/IDC/PLC and additional charges already paid to the builder as on 02 mar 2011.Only 5% of basic sale prices is left to be paid.

COMPLAINTS

- There is inordinate delay in offer of possesion, no likelyhood of getting the flat in next 1 yr even after making payment upto 95%.
- Complete insensitivity of the builder towards implementing penalty clause, it should have been adjusted from the total cost.
- No response to the query mails by the customer care
- Complaint filed with Consumer Coordination Council on 06 Aug 2010, complaint ID 15563/3/2010, but no response from the builder to the Council.
- Possesion offered for 2 BHK flats in some towers without Electricity connection and other basic amenities.

Ozone Park complaints

1. The greatest concern is delay in delivery of the flats. Shiv sai had promised the delivery of the flats by December 2009. it is already delayed by 15 months and delivery is not expected for another two years.
2. Quality of the construction is very bad. Wiring is not done properly and its going to be difficult to manage wiring in case any modifications are required. they have used plastic pipes instead of steel pipes for wiring.
3. The size/usable area of the apartments (unit A, B or C) is not same as one shown in sample apartment.
4. The finishing of the apartments is not good. cement is failling off the walls.
5. The steel grill in the balconies is a big problem. Balconies were not shown in sample apartments and ShivSai cannot expect us to have balconies with hollow steel pipes railings and height of ralling is very small, making it very dangerous.
6. The size of lifts is too small, and there is no service lift. we can not take big items like sofas or beds to top floors in this kind of lift.
7. The windows are wooden and are completely exposed. During rains the wood would get damage and would require replacement.
8. The green area - It is expected that shiv sai is just going to do a formality by planting some trees. We expect the project to be as good as it was shown in shiv sai brouchers.
9. shiv sai is planning to handover flats to owners even before completing the full project. it seems other features of the project will not be ready when they deliver flats in august 2011.
10. They do not have any plans to take completion certificate from HUDA ( Which is expected to check the safety and standards of the building) before handing over possession to owners
11. HUDA should make sure that builders pay the penalty for the delay in possession. they are trying to adjust the penalty with some fictional charges.

We met the DC Sh. Praveen Kumar today and he has instructed STP to look into the builder specific complaints. Complaints were submitted against RPS Group, Piyush Group and SRS Group. We could not submit complaint against any other builder due to lack of representation and final conclusive documentation.

If anyone wishes to submit a complaint for their respective builders, please finalize and consolidate all major complaints asap and submit it to the STP office in Faridabad by tommorow so that STP can investigate into the matter under the same case.

Is there any discussion on external development issue? In my view, main issue is with HUDA as farmers are still not giving land to HUDA and HUDA is just waiting.

- Facility ( Light , water , security, drainage ) no confirmation what Omaxe will provide after possession
- Charges of the services provided
- Adjustment of penalty
- Since construction is still going on site how to separate possession offer tower from rest of tower
- Internal Road & green area not completed
- Common Podium Terrace area cost Rs. 20790/- (38.5 sq. feet x Rs. 540/sq. feet). A new development. They are
saying it is a common area for use of everyone.
- Meter connection charges at Rs. 27900/- seems to be on higher side

I have a complaint against RPS. I have written atleast 15 mails to RPS but they are not listening. I have been literally cheated by the group. Can anyone advice me what to do now ?

Omaxe members - Please ensure that someone takes the responsibility of drafting the letter, submit and appear for any meeting requested by officials. This is a step we need to take seriously and does not end only with submitting the letter, but will involve a lot of follow-up. I am suggesting that members of different societies submit complain because this an opportunity we have which will not come again.

@Bhatt - The STP has not asked for any more complaints, but I am suggesting that everyone submits a complaint because they will consider the complain in the same case. I am not even sure if they are open on saturdays, so someone will have to check or visit personally. The complaint needs to be submitted at the STP Office to Geeta Prakash (STP), HUDA Office Complex, Sector 12.

Also I would suggest drafting the complaint letter in concise and precise format and categorize everything under different sections.

For e.g.

Delayed possession –
False commitments –
Non payment of penalty –
Changes in Layout –
Construction Quality –
Occupancy Certificate –
Unfair Charges –

Someone in the group will have to take charge and take responsibility.

Hi Gopal,

We are fighting against RPS as a group and will let you know about our next action plan. In the meantime you can prepare yourself for submitting a complaint to the EOW which we have already done. Please check the EOW thread for more details.
