A complaint has been Lodged In Bahadurgarh Police station against Era landmark Ltd for cheating Buyers. One of the Buyers writes:
Era landmarks had collected 20% money against sale of plots @ Rs. 6000/sqyds in 2006 at Bahadurgrh. they slept over the project for 7 years. now they are forcing customers to buy flats at current market rates which is too high. we are already united and opened a front against them. they are cheating us and now selling flat and collecting money from new innocent customers. please do not fall in their trap. any one duped by them in Bahadurgarh project can get in touch with me at 094**********. also See the video at this Link https://docs.google.com/file/d/0B1bDkWx ... sp=sharing

Thanks Naveen for sharing details on police complaints.

As more and more people become aware and start to file police complaints & legal cases against corrupt builders, supremacy of such builders will eventually die down and hopefully they will start to treat their customers better.

A RTI Reply clearly states that DGTCP office has no knowledge of any agreement Between the Licensee(Countrywide )& era Landmark, for construction of any GH colony in Sector 76 Fbd. Also no Building plan has been aproved in the name of era landmark Ltd. in Sector 76, Fbd.

This means that Secretly Era & Countrywide have agreed to do business, without the knowledge of DGTCP.
Or
DGTCP has no knowledge of Era developing Era Divine Court in Sector 76 Fbd.

While Era landmark is developing Era divine court openly with large Advertisement boards and Flags, and Marketing office of Era landmark at the Site.
Despite Complaints to DGTCP.CP,DGP,EOW,almost 4 months back, the authorities are not taking any action against the cheat Builder, which shows that all parties are in Collusion and do not care about the common man.

The agenda is regarding the Consumer case against Era landmark.Senior Members of GFWA will be their to guide us.

Yesterday a meeting was organized at Coffee Home, opposite Hanuman mandir, Connaught Place, Delhi, in That following points were decided :-

1. Following points should be raised in the draft of complaint to consumer court.
a- EDC- overcharging, Notification by HUDA to Era Landmark Ltd. asking the company to deposit specific amount to HUDA as EDC . Any Enhancement in EDC should be payable by builder because if builder provide house in time, there would not be any other EDC payment.

b. Penalty @ the rate of 18 percent interest , or Rent that we are paying .

c. Change in Layout plan without the consent of existing buyers e.g. in original layout there was a park area, but latter the company raised 44 Flats in its place.

d. PLC was charged for Green area in front & rear of flats but now the company has removed the green area at both locations.

e.Enhanced Circle Rate- E.g the buyers who had booked their flat in 2009 and they were promised possession by 2011, but till date i.e. 2013 the company has not given possession, and circle rates have been enhanced since 2011. So this burden of enhanced circle rate should be borne by the company ,For its fault,and not Customers.

f.The company is not disclosing the Carpet area or Built up area of the flats.

g. Mental Harassment by the company.

h. In High rise - The company is deliberately not constructing the Project. eg as per BBA they had promised possession within 36 month after commencement of construction of respective tower. Even after 34 months completion , the company has completed only Completion of Foundation. Customers are paying Rent , EMI and Company refuses to Pay monthly Penalty as per BBA ,

i. Revocation charge.- Rs 3.75 Lakh was extracted from few complainant by cancelling the flat.

j. The Builder is giving Threat to Cancel the flat to buyers who raise the issues of penalty , The builder is asking us to deposit EDC despite the Honorable High Courts stay order and also sending Cancellation threat letters if not complied with demand.

2.It was decided that we all will go to consumer court in a group and that will be under Era divine court RWA. National Consumer forum will be approached .

3.Also several times we raised the issue of Poor quality of construction being done at the project, but deliberately the company has not done anything regarding that, thus endangering the Life and property of future residents.

4 .We should ask the the consumer court to Bind the Builder to safeguard the interest (Money and House) of the customers , as The builder has no license and land in its name and is constructing,Marketing & selling the project under GPA/MOU ,with the licensee. e.g in case of a Dispute between the licensee (Countrywide) and Era landmark ltd.

1. The Builder is selling Parking space both open & stilt, which is clearly a violation of supreme court verdict against doing so.
2. The Builder is deliberately not Developing the High rise project , he has completed only foundation work in most of tower and in only one tower he has completed First floor roof slab, and for doing so he has taken almost 34 months, whereas he had promised to give possession within 36 months after commencement of construction as per BBA. The plan of the builder is to construct 7 towers with each tower having 22 floors. In remaining 2months + Grace 6 months, this is not possible, and he is threatening cancellation of flat on demanding monthly penalty, which he had promised in writing in BBA.

Despite of so many clear cut grievances of buyers , only few buyers have come forward for fighting the Consumer case against the CHOR Builder.
Even the Low rise owners who have crossed 2 yrs over & above the promised possession date and where the builder has refused to give penalty or expected date of possession, and all illegalities regarding the project, are so afraid to join the group of persons who are ready to fight against the Builder. People have decided to get looted, than not even GOD can save them. Any way best of luck to arm Chair protestors.

The builder has promised to give flat, which includes Electricity, water & sewarage charges and as per National building code 2005 these facilities are part of the Flat and should be included in the cost of the flat, but as builder is very active in making fool the buyers, the company has put EEC & FFC charges separately , that he is doubly charging the customer.
These facilities are part of IDC too,

Era says that it has done Irrevocable power of Attorney with Countrywide , And many buyers say that this is enouph for their satisfaction about the project.

PUBLIC NOTICE FOR THE INFORMATION OF PERSONS INTENDING TO BUY
PLOT/ FLAT IN PRIVATE LICENCED COLONIES OF HARYANA
The Department had earlier issued notices to caution both the general public as well as the
persons/companies/property dealers engaged in development/booking/sale of plots/flats in the
private licenced colonies of Haryana refraining them from sale/purchase/bookings in such projects for
which licence has not been issued by the State Government. In this regard a Public Notice had also been
issued in several national dailies in the month of April 2011 informing the public that they should
ascertain the complete details regarding licence granted to such colony before purchase of plots/ flats/
office space/ shops etc.
2. It has, however, been noticed that some of the colonisers still issue advertisements inviting the
gullible public to invest in a project even before grant of licence to set up the colony resulting into
misleading and defrauding the general public. While action against such unscrupulous elements is
taken by the Department, the general public is hereby cautioned not to be allured by such
advertisements and refrain from investing money in such projects for which licence has not been issued
by the State Government.
3. In this regard, it is also informed that plots/flats for residential, commercial, institutional and
industrial use etc. within the controlled areas and urbanisable limit as declared under the Punjab
Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963 and
Haryana Development and Regulations of Urban Areas Rules, 1976 respectively, can be sold only after
obtaining a license from the Department of Town and Country Planning, Haryana. The sale/pre-launch
of plots without a license is illegal and there is no guarantee of any such project ever taking-off. In
this regard the provision of Section 7 of the Haryana Development and Regulations of Urban Areas Act,
1975, is also reproduced below for reference:
Section 7: Prohibition to advertise and transfer plots. No person including a property dealer
shall:-
(i) without obtaining a license under section 3, transfer or agree to transfer in any manner plots
in a colony or make an advertisement or receive any amount in respect thereof;
(ii) erect or re-erect any building in any colony in respect of which a license under section 3, has
not been granted.
(iii) erect or re-erect any building other than for purpose of agriculture on the land sub-divided
for agriculture as defined in clause (aa) of section 2 of this Act.
4. Some unscrupulous persons and companies may indulge in illegal activities of pre-launch of
plots without obtaining a license for development of such colonies. Therefore, general public is advised
to contact and verify whether license has been granted by the Director General, Town and Country
Planning Department, Haryana before booking of plots/dwelling units/commercial property to avoid
any legal problems and financial implications. Details of contact persons and their e-mail ids can be
seen at Department’s website: tcpharyana.gov.in
5. The persons/companies/property dealers are again cautioned not to sell/pre launch or offer
plots/dwelling units/commercial property without obtaining license from Department of Town and
Country Planning, failing which legal action shall be taken against them.

Recently the National consumer commission has stated to give very pro consumer judgements and one example is attached with this post.

are the indications of change that is encouraging for all. These builders cant give any buyer what these courts can give. Patience and determination is the eligibility.
