As discussed with RPS people, prepaid meter card deposit of Rs. 50 K will be an advance deposit towards consumption of electricity and monthly maintenance charges.

I think not a matter of big concern as deposit money will rest with JLL (maintenance agency) and not RPS.

congratulations to RPS Savana friends for getting possesion letters. but be careful while paying for demands as in few cases there are court orders(stay). these are shared in piyush height chains, please check before payment.

Valuable information shared by member 'BlessU', please read below.

I would recommend immediate action to be taken by all who have been offered possession.

Fire Fighting Scheme is governed under the NBC (National Building Code) 1983 Part IV, revised 2005 https://law.resource.org/pub/in/bis/is. ... 5.svg.html titled 4 LIFE SAFETY

and approved by Fire Station Officer Faridabad and Fire Officer (HQ) Chandigarh. The local Fire Station Officer Comes under Commissioner, Municipal Corporation of Faridabad. Copy of application, approval, fees paid and specifications be obtained through RTI

The "Fire Fighting Scheme" has to be provided by the builder as a part of "Building Plan", submitted for procuring its approval from DTCP. Copy of Building plan including the Fire fighting scheme be obtained through RTI

Before any RTI is filed, in my opinion immediately

1- Seek clarification on exhorbitant charges towards Fire fighting and ALL OTHER inappropriate charges, from builder. Asking for "clear" details of costs, specifications, vendor deployed under cc to DTP Faridabad, DGTCP and DC Faridabad

a) Please provide comparative of charges quoted by other builders in the area for Fire Fighting(with similar scope and size in the complaint.) CLEARLY questioning why RPS buyers are asked to pay X amount is higher by Y amount in comparison and justification for the same.

b) Please quote the relevant BBA text on such charges and mention, that this was excepted after trusting and having faith in the capabilities of builder towards procurement, erection and execution of such fire fighting system, to provide the most effective and value for money.


2- Separately, forward a formal complaint with signatures from all those who have been offered for possession to DGTCP. Include all other illegal charges and defective execution of approved Zonal/Layout/Building Plan in violation of Agreement/Licensing Conditions and undertakings given.

3- File a Criminal FIR for Illegal construction (such as School in Greens and violation of the act, if applicable). Send a copy of FIR to DGTCP/DC and DTP for investigation and corrective action.


RTI can be filed with DTCP and Chief Engineer HUDA asking for scope and specifications applicable for GH towards Fire fighting under the license.. i dont think they will give an opinion on cost. however on obtaining the scope and specs for the license in question, you can get quotes from vendors and file a criminal case of Cheating and extortion

Please take your own considered decisions under a legal counsel.

Hi

If you ask for delay in " possession payment" then you will charge 24 % more on account of escalation of increase in input cost... these are the fine lines mentioned in the possession letter. ... please carefully read the notes....

Input cost has increased because it took 6-7 years to build. They cant expect that cost will not escalate if there is a delay.

People have paid huge interests and the delay charges are just peanuts and that too is not being paid. Based on some of the recent judgments which I have seen against the builders, I don't think this argument has any chance of surviving in the court.

Possession letter received by a member, flat bought @2546 /sq.ft. on May 2012.

Possession amount of Rs.10 lakh+

RPS Group, as expected is another group of thugs and lootere.

Even their latest price list mentions,

  • Prices are firm and escalation free from the respective dates of Booking.
  • Possession will be offered within 24 months with penalty clause as per Buyer's Agreement

I don't know if members are paying the final demand willingly or they intend to put up a fight.

I am not going to pay just like that.
I am going to ask about Penalty on delay for sure and FF charges (which is too huge).

Dear jayanta,

In letter its mentioned escalation of24 %cost of raw material and labour which is liable to pay .is this amount is extra from specified amount in letter...

I had a discussion with a lawyer friend and he has suggested to approach the consumer court. He told that civil case will take years to settle even if many consumers file the case in a group.

As per him cost of escalation will be tough to prove unless their was some trouble from govt side due to which builder could not construct and took this much time.

The possession is not applicable for me. So its for the people who have got he possession to decide what they want to do.
