Hi All,

I have a flat in Eleganza tower, flat no 1001 in Ph 2. Today I received a letter from builder for payment of additional EDC charges. Revised charges are Rs. 312.88/sq feet, which is too high and also the time given is only 15 days.

Has anyone got the similar letter from builder. We need to come forward and collectively meet the builder to discuss:

1. Time given to pay the charges
2. Calculations for revised charges, which is too high as compared to other builders in the area
3. Possibilities to pay the charges in installments
4. Other concerns

I propose we should go as a group to the builder to put pressure on him. We all can meet at the site this weekend. Pls come forward with your views on this.

Dear Sumit..

I have also received letter for enhanced EDC yesterday. Its really shocking. The following points need to be addressed.

1) How much the amount in actual is to be paid.
2) How the amount was worked out. The calculation sheet showing details is needed.
3) The builder took almost 7 months in sending letter to us. Is the builder charging intrest from us for these 7 monts also.
4) The time given to us is very less.

Lets unite together and discuss our strategy.

Hi All

Request for a joint meeting in Faridabad on Saturday (as it is working for builder office as well). Let us all go togather to understand the following

1. Working of EDC
2. Letter was issued on 15th Dec but why it was posted on 27th Dec.. 15 days time to pay amount like 4 lakh is too less
3. Clue on possession
4. Why enhanced EDC is not getting adjusted against possession delay penalty

Let us make it this saturday @ 11 am outside Nuchem office of SPR.. wat say guys?

I too have received a letter dated 15 December for demand of further EDC payable by 15 Jan 2012. It says Interim EDC demand@ Rs. 125 psf= 235125.00 Revised EDC payable@ 295.72 psf= Rs. 556249.32. Difference to be paid= Rs. 321124.32. Have you got the same figure? Since I'm out of India I will not be able to join the meeting. All the best to all and keep us posted about the outcome of the meeting.

Is the matter still sub-judice or there has been some decision by the court about the payment of extra EDC.. kindly update. Please also let me know whether the forum members are going to pay or we should wait for high court decision.

I had also received the same letter. Do any one know about
1. what is EDC charge / square feet to be paid ?
2. Is the rate calculated on saleable area?

Hi,

I have also received the revised EDC letter yesterday. Letter dated at 15.12.2011. It says Interim EDC demand@ Rs. 159 psf= 299079.00. Revised EDC payable@ 345.64 psf= Rs. 650148.84. Difference to be paid= Rs. 351069.84.32. I called Ms. Poonam at SPR office but she is not picking the phone. Got to know from SPR office that Mr. Sanjay and Mr. Pramod are the ones who will be explaining us the details for this letter. Both the numbers they provided me for Sanjay are not connecting. Finally got the number for Pramod and spoke with him. He explained me that government has asked them to pay the revised EDC effective 2009 with interest. So they have distributed the whole amount among buyers including their interest. The reason he explained for difference in everyone's final EDC amount is depending upon the tenure when you book the flat. On further questioning about the calculation part and actual letter from government, he said you can go to SPR head office and see the letter.Mr Pankaj from Accounts will be able to clarify it for you.

I have a flat xclusive 502 phase-1.
I have also received the revised EDC letter today. Letter dated at 15.12.2011. It says Interim EDC demand@ Rs. 125 psf= 235125.00. Revised EDC payable@ 261.40 psf= Rs. 491693.40. Difference to be paid= Rs. 256568.40.
Please let me know whether Forum members going to pay the amount or not.

Matter is sub-judice (GFWA is having ongoing case in High Court for quashing of increased EDC against Haryana Govt.) and next date of hearing is 31-Jan-11. Detailed updates are provided in GFWA exclusive section. GFWA needs constant support from forum members for organizing protests, meeting officials and proceedings in legal cases. Request every forum member to become GFWA member and help in common cause !

Hi Dheeraj,

Kindly suggest about the letter which SPR has sent to every one for payment of additional EDC till 15 Jan 2012 since court hearing is 31 Jan 2012.

Please and kindly take another date in March or whatever later date when you meet on Saturday. I am not in India otherwise I would have rather joined to you guys.

Hi all SPR members,

Town and country planning department, Haryana under the signatures of Mr. T C Gupta, IAS, Director, Town and country lanning issued a public notice which was published in all news papers states that :

All the colonizers who have been granted licences in Faridabad under the provision of the Haryana Development and Regulation of Urban Areas Act, 1975 and Rules, 1976 thereof, are hereby informed that the Haryana Urban Development Authority vide Memo No. HUDA-CCF-Acctt-I-2001/17904 dt. 25.5.2011, has conveyed the following revised rates of External Development Charges ( hereinafter reffered to as EDC) for Urban Estate Faridabad for the calander year 2009 :-

For plotted Development Rs. 58.21 lacs per gross acre
For group housing Scheme with 400 PPA density Rs. 232.84 lacs per gross acre
For low lost affordable housing with 600PPA density Rs. 174.63 per gross acre
For commercial area including neighbourhood shopping Rs. 271.84 lacs per gross acre

2. These rates are applicable for the sectors from 66 to 89 on the eastern side of the Agra Canal and in respect of the balance unsold area as on 1.1.2009 of all sectors in the western side of the Agra canal.

3. These rates are applicable for furtther four years i.e. upto 2013 by increasing the same by 10% p.a. on compoundable basis. On the same pattern, these rates will be made applicable for the calander year 2005 to 2008 after reducing same by 10% p.a. on compoundable basis.

4. The EDC for the licences issued beween calender year 1997 to 2004 will be charged as per EDC rates finalised for the year 1994 vide memo. no. HUDA-CCF-Acctt-I/6305 dt. 1.3.1996.

This will be subject to terms and conditions which can be seen on the website of the department at http://www.tcpharyana.gov.in

Now i have few points :-

a) Is the builder charging from us strickly as per above order/ notification.
b) Is the EDC being reduced for the period 2005 to 2008 by 10 % p.a. on compoudable basis ?

Hi,

I have also received the demand letter having the differential calculation of Rs 125 to 322 amounting 3.71lacs!! Its huge demand which I would suggest not to pay till the case hearing suggested by Dheeraj on 31st Jan'12, & let's meet SPR officials for extending the time as well as not imposing any interest so on!

I think, if that's doable, builder will support us.

I tried to fetch some information from friends who has flat in BPTP about the same, so far they haven't received any such demand.

Hi All,
I too saw this letter which I received only on my e-mail & not by registered post. I guess we must meet to take a call on this and in the mean time at an individual level find out how the revised edc is being charged by other builders.
I am not available on Saturday 31st Dec 11 but am available on Sunday, 01st Jan 12. If about 11.00am suits all on Sunday then we all can meet first at the sample flat (site office).

Hi Ajay Ji

As we discussed on phone, rates given in this notification are of year 2009. Increased EDC rates have to be decreased compoundedly by 10% for each preceding year (2005 - 2008). Please ask your builder for calculations. Also, as we discussed, inform time and venue of SPR buyers' meeting. It is an excellent oppurtunity for SPR buyers to get involved in common cause and become members of GFWA
