We need to add in our main agenda few more points as under:

1. Copy of license, approved construction plan from D.T.C.P, receipt of EDC amount.
2. Audited balance sheet - We envisage they have siphoned the money.
3. Progress of work by their sub-contractors in last 2 years. They have 4 Sub-Contractor.
4. Nomination of members from RPS who shall attend the regular meeting with association.

The above points shall be added to the main agenda including Jayanta points.

Hi All,

I would like to add few more questions for RPS.

-How can they enter into 36 months possession agreement with the buyers in Oct'06 when they have not even filed building plan for approval till Jan'07. Now they say that 36 months will start from the day excavation starts.

I am sure builders can manipulate delaying approvals from DTCP till the time their projects are sold to a certain limit (viability to start construction and make profits). They (in association with govt agencies) cheat innocent buyers selling homes without proper approvals.

- If the school in the township offers admission to outside students too, how this is not a separate commercial venture of RPS?

- The infrastructure shown to us while selling was meditation hall, piano court and many other facilities which do not exist now. Why should RPS not be liable to pay back certain amount to buyers for not giving these facilities?

- Club, Swimming pool etc was meant for Savana owners. Now they have added 600 families from RPS Palms to the same infrastructure. How can they do this? I understand that as per our agreements, these facilities remain properly of the developer but then what’s the guarantee that tomorrow RPS does not start swimming classes for outsiders in the Savana swimming pool?

Here is the final draft of the agenda prepared for our meeting with RPS Group on 19th Oct. Please go through the agenda and reply by tonight with suggestions if changes are required. I will be sending the agenda to Mr. Rajesh Jain tomorrow morning. The agenda is also included as an attachment word document.

Agenda – Meeting with RPS Group, 19th Oct 2010

1. Resolve domain name dispute – As per our offer and decision by the arbitrator presiding over the domain dispute complaint, we will handover the domain http://www.rps-savana.co.in to RPS Group. As an act of good faith, we need a written confirmation from RPS Group that they will not pursue the case and officially close the complaint.

2. Allow construction site visit - In our last meeting with RPS Group officials Rajesh Jain and Shailendra Nangia on 3rd June 2010, we had suggested allowing of Savana site visits atleast once in a month to check the construction status. Every developer in the area and NCR allows site visits and there is no reason why RPS Group should not allow the same. Internal site visits are a right to every customer and we are willing to take any approval from the authorities or sign an undertaking understanding the risk involved with the ongoing construction inside the project. We want a definite date when site visits will be allowed inside RPS Savana project.

3. Schedule regular meetings with allottees and RPS Management - In the last meeting, it was also decided to have monthly or atleast quarterly meeting with RPS Group officials and customers. We want a nomination from RPS Group to act as a SPOC and work along with us to convene these monthly meetings.

4. Stagnant Construction progress - Why RPS could not complete the building construction works within the agreed time schedule of 36 months? Any reasons which were beyond the control of RPS and could be treated as force majeure conditions? In one of the discussions with your office, reference to clause 13 “ the possession of flats can be delayed by builder subject to ‘force majeure circumstances’ and clause 50 of the buyer seller agreement” was given which is not applicable to the current circumstances.

5. Penalty Clause - Since the scheduled period for completion of works (36 months from date of buyers agreement) has already expired. Thus penalty is to reimburse on a monthly basis by RPS. For the period already lost, an interest is due to RPS which should be regularized immediately. Our cash flow was planned according to possession. We have lost the opportunity however our liability towards rent and EMI remains. The penalty shall help us to meet the part requirement of EMI.

6. Internal Development and Amenities - Why other construction activities like road, park, swimming pool, club and other amenities which were agreed by them and were in their master plan has not even been started?

7. Timeline - When does RPS intend to complete the building works and internal development? Whether RPS will start giving possession to the flat owner on progressive basis as and when a particular tower got completed or whether they will offer possession only after completion of works in all towers? In case of progressive/phase wise possession, what is the likely date of offering possession tower nos. We require schedule for completion.

8. Basic Amenities - Whether RPS will make arrangement for electricity, water and sewerage by their own resources (even though it is chargeable) to start living in the flat in view of the HUDA inability to provide them in near future.

9. Proposed schools instead on green area and change in master layout - We have realised that two primary schools are coming in the demarcated lawns are near Bluebeech and Bayberry Tower . Whether RPS will return the PLC amount taken from the flat owners which were meant for Park facing flats? Also RPS is learnt to have allocated land to KR Mangalam World School and dispensary in the proposed green theme park.

a. Why was the master plan altered after selling the project basis green areas?
b. Whether RPS will return the PLC amount taken from the flat owners which were meant for Park facing flats.
c. If the school in the township offers admission to outside students too, how this is not a separate commercial venture of RPS?

10. Sharing of amenities proposed for RPS Savana – Does RPS Group have any plans of sharing amenities inside the Savana project along with other RPS City projects like RPS Palms and RPS Rhythm?

I have slightly modified the agenda and added one more point. It is final for my end to issue.

4. Super Area Calculation – We realize land use within the plot have changed. We look for area calculation sheet including the area which is used for common purpose?

8. Timeline - When does RPS intend to complete the building works and internal development? Whether RPS will start giving possession to the flat owner on progressive basis as and when a particular tower will complete? We require schedule for completion for each tower.

9. Basic Amenities – We need the payment receipt of E D C charges paid to the government? When shall the basic amenities viz electricity, water and sewerage shall be ready within the RPS plot?

10. Proposed schools instead on green area and change in master layout - We need copy of approved layout plan by D.T.C.P. We realize that land for lawns near bluebeech and bayberry tower is changed to two primary schools. Such changes are breach of agreement. There was PLC paid for park facing, swimming pool facing etc.

Also RPS is learnt to have allocated land to KR Mangalam World School and dispensary in the proposed green theme park.

As of now there is no change of plan, we are still meeting tomorrow at 11AM. (I am not able to access my admin email ID, so I am not sure if there is any response from RPS)

We are expecting good participating from Savana members, please try to be there by 10:30 AM so that we have enough time to gather.

Please let us know the outcome of the meeting with RPS Group on 19th Oct 2010 on agenda which was posted here.

Another thing, I have read today in some website spacesellers that RPS is giving possession for RPS Savana in mid 2011. Thats a shocking news, but just curiuos to know the outcome of yesterday's meeting .

Thanks to all the members who came inspite of their busy schedule to spare some time for this cause.

The meeting was a mixed bag, with heated arguments and discussions.

The agenda was emailed on 18th Oct to Mr. Rajesh Jain (rajeshjain@rpsgroupindia.com) and info@rpsgroupindia.com, copied to several of our members. Rajesh Jain was naïve enough to say that he did not receive any copy of the agenda which was purely unprofessional on his part. He refused to let us meet any of the board members, stating our concerns in the agenda were not genuine enough for the board members to answer. We gave them 3 days to arrange a meeting with the board members. We also decided to go ahead with the formation of an official Savana association to help us take any action.

Atleast this was possible due to our experienced members pitching in with their valuable opinions and reasoning with RPS Group. If we go as individuals, RPS will feed us the same story and show us the door politely. We cannot do anything unless we show our unity in strength; I would urge everyone to start taking active interest in these meetings and contribute personally if we want to protect our investment, a handful of members from a 2000 strong community cannot fight for the entire community.

Hi All

For those who couldn't join the meeting : Mr Jain didnt even took a second to state that they should be able to start delivering possession by end of 2011, With the amount of planning and effort RPS is putting in for Savana, anyone can bet it will either never happen or will take much longer, Unless we get together and push RPS to get acting in professional manner.

RPS is not equal to Mr Rajesh Jain,

Incase anyone has email address and phone numbers of senior management in RPS, Please continue to bombard with email and phone, We cannot let it be ....

Over the past three years We have heard enough number of times from RPS spokesperson and sales team, and as we requested you in the previous meeting, now we would like to hear the plans directly from the board of directors and senior management, We would like to close this meeting any date on or before 25th October 2010, Please revert back with the name and designation of people from RPS attending the meeting along with date, time and venue of your choice.

NOTE : Please don't come up with excuses like mail not received or directors not available in town, as both RPS and the people who came in for meeting previously are very much aware that the senior management were available in office during our previous meeting, but the customers were not allowed to meet them.

I am marking a return receipt of this email, so that you do not have an excuse of mail not received this time.

In case you have any further concerns please feel free to revert back.

I called up RPS office, the office numbers were not working, Called up Mr Jain, His response was absolutely absurd to say the least.
Called up RPS office. None of the office phones were working, called up Mr Jain, Read the conversation, Next time onward I plan to record the calls.

Seema : Mr Jain, Today being third day from our previous meeting, I wanted to check if you have received my email and would be in position to provide some details"
Mr Jain : Yes, I have received
Seema : Ok, By when we can expect a response from RPS
Mr Jain : "We are on the job and will get back"
Seema : Would you be in position to give a time line for response and meeting date
Mr Jain : "We cannot"
Seema : "Sine we would probably need to take a day off, and plan our schedule, I need to know the date.
There has to be a date and time.. You can tell me today , tomorrow, one week , two week , one month .. but I need a date and time by when you can schedule a meeting with your officials"
Rajesh Jain : "I cannot tell you This will done based on our convenience"
Seema : "Ideally this has to be in convenience of both, but still can you call up your managers and check when it would be convenient for them to be available"
Rajesh Jain : I cannot do this
Seema : Would you be in position to revert back and provide a written response specifying the unability to arrange meeting
Mr Jain : We are not bound to do that.
Seema : You are not leaving us many options MR jain
Rajesh Jain : "Do what you want"

RPS Group is starting to show its true colors now. And Rajesh Jain's behavior and attitude is definitely spoiling customers relationship.

Dear All,
When everybody know and agrees that RPS will not give any proper response to us, why are we not taking the legal recourse.
That is the only way RPS can respond. Additional pressure thru the media will help as well.
I really want to know what's stopping us? We have numbers, willingness, we are much more aware customers now, basis collective knowledge, inputs from all, RTI, media, etc
At least 3 dealers have told me that no development is expected to START before 2013 in this area.And RPS will stall us as long as possible.
In the next call, meeting please decide on this recourse as well.
