The ambitious plans of the Vigneshwara Group of Companies to develop a state-of-the-art cyber park at Gurgaon has hit a roadblock with the Haryana government canceling its licence granted on April 24, 2009, for violation of terms and conditions.

An order issued by the Director-General, Department of Town and Country Planning, listed a number of deficiencies which resulted in “blacklisting” of Aquarius Buildcon Private Limited, a firm of realty giant Vigneshwara Group of Companies.

The deficiencies detected by the department included default by the firm on an amount of nearly Rs 33 crore, including Rs 30.65 crore on account of external development charges (EDC), Rs 2.29 crore for internal development charges (IDC) and about Rs 6.88 lakh as licence renewal fee.

Besides the non-payment of the statutory dues, the developer did not submit the no-objection certificate (NOC) from the competent authority. Also, the compliance certificate was not submitted by the company.

Not blacklisted by DTCP, builder says

GURGAON: Following the news story, 'DTCP blacklists builder in Gurgaon' published in TOI Gurgaon Edition dated March 15, 2013, Sunil Kumar Dahiya, CMD, Vigneshwara Group of Companies, has sought to clarify that the report was not entirely correct, as there has been new developments regarding the issue.

The article was based on the DG, Town and Country Planning Haryana, order dated March 4, 2013, and wrongly mentions that the DTCP, Haryana, has blacklisted and cancelled licences of Aquarius Buildcon Pvt. Ltd and Vigneshwara Group of Companies for Sector 74, Gurgaon-Manesar Urban Complex.

Dahiya said: "We wish to clarify that our licence was ordered by the DG, DTCP to be renewed on September 5, 2012 and we were to be issued zoning plan. The EDC was to be paid within six months of the zoning plan."

According to the builders, their licences were ordered for renewal on September 5, 2012 vide memo LC-1506-JE (S)-2013/33455 as per order of the Director General and allowed to proceed with noted compliances in its terms, that are under review by the office of the DG, TCP Haryana, vide its memo dated March 13, 2013. The DTCP's March 4, 2013 order is thus not final.

The DTCP order, dated March 4, 2013, had stated about the outstanding payments, including non-deposition of Rs 3,064.98 lakh on account of External Dev- elopment Charges (EDC) and Rs 229.630 lakh on account of Internal Development Charges (IDC).

Dahiya said the EDC has to be paid after the issuance of the zoning plan that is done by the DTCP. "We have put in a review application for the issuance of zone planning as soon as possible, which is under review as per sthe memo dated March 13, 2013. Any erroneous remark with respect to our licence has been removed from the official website," said Dahiya.
