फरीदाबाद। नहर पार प्राइवेट बिल्डिरों द्वारा विकसित किए जा रहे प्रोजेक्टों पर संकट छा गया है। अभी तक इन प्रोजेक्टों को पूरा होने में किसान ही रास्ते का रोड़ा साबित हो रहे थे। लेकिन प्राइवेट बिल्डिरों ने पर्यावरण अनापत्ति प्रमाण पत्र न लेकर खुद अपने रास्ते में अड़चन पैदा कर दी है। प्रदूषण नियंत्रण बोर्ड ने इसे लेकर 20 बिल्डरों को नोटिस जारी कर दिए हैं और एक सप्ताह में पुलिस में रिपोर्ट भी दर्ज करा दी जाएगी।
प्रदूषण नियंत्रण बोर्ड के अनुसार, नहर पार बनाए जा रहे अधिकतर प्रोजेक्टों में पर्यावरण को ताक पर रख दिया गया है। इससे भविष्य में पर्यावरण पर भी काफी नकारात्मक प्रभाव पडे़गा। प्रदूषण नियंत्रण बोर्ड के अनुसार, 20 हजार स्क्वायर फीट में फैले किसी भी प्रोजेक्ट को बनाने से पहले पर्यावरण मंत्रालय से पर्यावरण अनापत्ति प्रमाण पत्र हासिल करना होता है, जिसकेलिए बिल्डरों को मंत्रालय के समक्ष यह साबित करना होता है कि उनके द्वारा बनाए जा रहे किसी भी प्रोजेक्ट से पर्यावरण को नुकसान नहीं पहुंचेगा और न ही वहां पर रहने वाले लोगों को किसी तरह की परेशानी होगी। लेकिन कई बिल्डरों ने बिना पर्यावरण अनापत्ति प्रमाण पत्र के ही काम शुरू कर दिया। इसके लिए प्रदूषण नियंत्रण बोर्ड को भी सूचित नहीं किया गया। इसलिए प्रदूषण नियंत्रण बोर्ड ने ऐसे 20 बिल्डरों को नोटिस जारी कर दिया है।

नहर पार हैं कई प्रोजेक्ट
नहर पार ग्रेटर फरीदाबाद में न केवल हुडा द्वारा बल्कि प्राइवेट बिल्डरों के भी प्रोजेक्ट चल रहे हैं। जिसमें विला और फ्लैटों का निर्माण किया जा रहा है। इन प्रोजेक्टों को पूरा करने के लिए किसानों की कृषि योग्य भूमि को भी अधिगृहीत किया गया है। जिला प्रदूषण नियंत्रण बोर्ड के वैज्ञानिक हरिश्चंद्र ने बताया कि किसी भी बिल्डिंग को तैयार करने के दौरान कई तरह के कण हवा में मिलते है, जिससे आसपास रहने वाले लोगों को भी काफी नुकसान होता है। इसलिए पर्यावरण मंत्रालय द्वारा पर्यावरण अनापत्ति प्रमाण पत्र लेने का नियम जारी किया गया है।

बिल्डरों पर होगा केस दर्ज
प्रदूषण नियंत्रण बोर्ड के क्षेत्रीय अधिकारी एस बुद्धिराजा ने बताया कि एक माह पूर्व चंडीगढ़ मुख्यालय से अनापत्ति प्रमाण पत्र को चेक करने के बारे में निर्देश आए थे। तब प्रदूषण नियंत्रण बोर्ड द्वारा 20 बिल्डरों से प्रमाण पत्र जमा कराने को कहा गया था। लेकिन किसी भी बिल्डर ने प्रमाण पत्र जमा नहीं कराया, जिसके बाद पूरी रिपोर्ट चंडीगढ़ मुख्यालय भेज दी गई। जहां से इन सभी बिल्डरों को नोटिस भेजने का आदेश दिया गया। उन्होंने बताया कि एक सप्ताह के भीतर अगर बिल्डर अपना प्रमाण पत्र जमा नहीं करवाता है तो उस पर केस दर्ज करवा दिया जाएगा। केस के निपटने तक काम को भी रोका जाएगा।

This is clear negligence of the so called government department.
Working of all these projects are going on under their nose for last 6-7 years. And now when the projects are nearing to completion, they are sending notice to builder for environment clearance/violation.
It can happen only here.

Crime is punishable with imprisonment and fine.

Always make DTCP a party as it is finally their responsibility to ensure that compliance to EC is there and an Independent Agency/Expert Certification for adequacy and efficency of STP is provided.

DTCP/STP is the holly grail of all corruption and they are abetting and sheltering serious criminals in the form of builders.

Have faith in law as is meant to protect the ordinary as long as the basics are followed.

I would urge all those who have received OFFER of POSSESSION from their builders should immediately ask for the above independent certification for adequacy and efficiency of STP.

Those pursuing legal case should include this serious lapse by builder. YOU ARE BOUND TO WIN IS GUARANTEED WITH THIS ANGLE

I agree with dube_s. When projects are near completion, Environment Department is sending notices to colonizers. Where were they for the last 6 years? Intention of department looks bad. Also, why are they asking colonizers to provide them proof of environment clearance? Why can't they check their own records? I am sure most of colonizers will be having evironment clearance as they are NOT fools. This is an another example of exploitation and high handedness by Govt. department.

Hi,
Just a suggestion, if we raise a RTI application with environment deptt of haryana as well as with DTCP and ask :
a)whether the builder has submitted the environment clearance or not ?
b)Did they check the same any time before or at the time of approval of license?
c)by there own rules when are they suppose to check the same ?

not sure how much truth is in this story...
people have already started living in newly constructed societies which have already got OC from dept. as far as I know OC is really last step in these projects
at last HUDA has floated tenders for master road and sewerages and work is actually started...doesn't HUDA need environment clearance to build infrastructure in this area...

it is very difficult to believe that there is no clearance from Enviornmnetal dept for NP projects...

u never know it might be some dirty tactics to create panic in the environment which is just trying to wake up from long sleep...any thing possible..

I agree. This report is planted to spread panic.

There is tremendous buying interest in Neharpar and very limited units are left. Influential financiers may be involved in planting this news.

Basics first
The Environmental Clearance certificate or EC is required to be obtained by any builder before start of construction.
This certificate contains rules, regulations, guidelines pertaining to various acts,
These are required to be followed by the builder during and ensure the same at the time of offer of possession of the units
These pertain to Water, Adequate Electricity load, Air, Solid waste, Sewerage/sullage, Noise, Greens etc.
Once the Housing construction (Appt,Villas, Plot, Township) is ready, the builder is required to get
"An Audit inspection certificate from independent/third party or agency pertaining to the adequacy and efficency of the STP etc!!!"

This is separate from EC which is issued at the start of work..

Builders are required to provide this is as per their EC and licensing conditions, which unfortunately they dont :@
Instead they keep calling demands for to this account without completing the internal infrastructure of which STP is very much a part apart from Clean, wholesome water supply, adequate electricity load application and sanction, development of common areas etc..

Many builders like BPTP have offered possession for plots without providing basic facilities. Hence the complaints and therefore the action.

Yes, Polution control board should have acted earlier but if they have done now on the basis of complaints, it is not for market rigging but for ensuring that spurious offer of possessions be stopped and genuine work be provided by builders for endusers benefit.

Further, would like to add that all builders are complaining that HUDA has not provided services while if they look into their licenses from DTCP, it is clearly mentioned
"The coloniser shall provide services in the respective area, till these are made available by HUDA"

Therefore, the builders are in for some real rough time and the ambit of Envirornmental Impact assessment is not restricted upto pollution control but also water, sewerge, proper electricity load, parks, green belt etc.

I am sure those properties that have been delivered will be fine and others like BPTP will have to catch up soon :cool2:

Its not the Pollution Board, but the builders who have taken 95% + money with no internal development in terms of common area, common facilities, greens etc.

BPTP offereing possession without basic services and claiming lakhs to be deposited in few weeks time.. is one of the prime examples of flouting each and every rule in the book.

Despite requests to builders for providing self/third party certifications pertaining to completion of responsibilities under the service agreement (BBA), buyers get vague, non conclusive remarks like.. "work is in progress".. "we are working on your concern"... "we do not provide any certification".. etc..

Fact is the builders are obliged to ensure that necessary and essential works are completed as per licensing conditions and EC, and final independent certificate obtained from agencies about the adequacy and efficiency of STP etc.

Apart from that just got to read a license of a builder which clearly mentions that

"The coloniser shall provide services in the respective area, till these are made available by HUDA"

Clearly, all builders are making a mickey out of the homeseekers by stating that HUDA is delaying the services because of which we are not able to offer possessions.

Let us talk on facts.

- Why is Environmental Control Board NOT looking at its own records and instead demanding certificates from colonizers? Are colonizers a million that they can't find record for them. Just a handful of colonizers. Instead, threatening them with legal notices and actions without having any proof of non-compliance.

- I agree with BlessU that Environmental Clearance occurs before start of construction. Some one had filed RTI for my builder (Piyush Group) and indeed they got Environmental Clearance before start of construction. Colonizers are not fools.

I agree with flat-deals.com that this report has been planted to create panic !

फरीदाबाद। प्रदूषण नियंत्रण बोर्ड ने पर्यावरण को ताक पर रखने व नियमों की अनदेखी करने वाले बिल्डरों के खिलाफ कडे़ कदम उठाने शुरू कर दिए हैं, जिसके तहत बोर्ड ने 4 बिल्डरों को एनओसी न लेने पर नोटिस जारी कर दिया है।
जिस निर्माणाधीन बिल्डिंग का एरिया 20 हजार स्क्वायर फिट से अधिक होता है, उसे बिल्डिंग बनाने से पहले प्रदूषण नियंत्रण बोर्ड से एनओसी लेनी पड़ती है। गौरतलब है कि प्रदूषण नियंत्रण बोर्ड द्वारा नहर पार के 20 बिल्डरों को भी ऐसे ही मामले में पिछले दिनों नोटिस जारी किया गया था।
प्रदूषण नियंत्रण बोर्ड के क्षेत्रीय अधिकारी एस बुद्धिराजा ने बताया कि चार बिल्डरों को और नोटिस दे दिया गया है। उन्होंने बताया कि प्रदूषण नियंत्रण बोर्ड की एक टीम पूरे फरीदाबाद में सर्वे कर रही है। जहां पर भी बडे़ प्रोजेक्ट का काम चल रहा है। उनसे एनओसी दिखाने के लिए कहा जा रहा है।

why dont they publish the name of Builder. If this is really true.
By hiding the names they want that innocent public looking for their dream homes get duped,Or else this is a ploy by the Corrupt govt to extract booty from the builders .
