Dear all
in my opinion followinf steps can be followed to tackle this issue -
1. first let us ask detail calculation of the previous super area and new demanded super area (increase of almost 180 - 190 sft) from the builder which they have said in their letter that their project architect has certified.
2. let us get the copy of the sanctioned drawing as well as the completion drawing (the builder have indicated that they have received the partial completion certificate) from DTCP office, chandigarh through RTI.
3. check if there is any difference in the area of the flat and overall area of the project.
4. if there is no difference in the area of the flat or the overall construction area then the builder is taking us for a ride. if there is a difference then it has to be analysed, checked and then can be paid for if found the increase in area to be genuine.

This can be termed akin to dowry demand by greedy in laws and as the dowry demand never ends so does the builder demands never end.

The buyer can be put in the same shoe as poor father who keeps on fulfilling the demand :cursing: :-[ :@

For dowry demand, there is a draconian IPC 498A. Where is the law for controlling builders?

With regards to increase in super area, you can use template below :

Once you have declared this increase in (super) area, we hope that all measurements have been done and certified by competent authority in this regard. You will appreciate that it is ultimately the buyer who will be paying for this, provided same are properly justified by the measurement records/ certification by the competent authority proof of which is to be provided by Company immediately to the Buyers based on the declaration made by Company of increase in super area through footnote in the above mentioned letter.

No complete supporting documents & calculations have been provided justifying increase in area so far.

You are requested to provide the following calculations along with certified supporting documents at the earliest, as being committed by your staff, for our review and perusal:

1. Complete calculations (i.e. with break-up dimensions of each area/ room /amenities) for arriving at the original super area

2. Complete calculations (i.e. with break-up dimensions of each area/ room /amenities) as per As-Built status for arriving at increased super area

3. Please ensure that your above calculations for Sl. No. 1 and 2, do include the following:

a) Carpet area dimensions considered in the calculations

b) Loading factor considered in the calculations

c) Calculations for saleable super area =. Carpet area + (Carpet Area x Loading Factor)

d) Carpet to saleable area ratio

e) Comparative dimensions in ft. and areas in sq. ft. of all rooms /areas, kitchens, living room, bed rooms, bathrooms, balcony etc.

f) All calculations for increased area shall be based on actual and certified measurements for As-Built status.

Please note that in the absence of above certified and supporting documents and calculations, one cannot expect to force the customer to pay the additional amount (neither now nor at the time of possession) till you immediately provide all relevant documents in support of your claim for increase in area. Delay by you in providing these calculations and certified, supporting documents shall be solely to your account and we cannot be held responsible for non - payment/ late payment of this additional amount at any stage resulting due to non providing of relevant calculations and certified and supporting documents by Company in justification of declared increase in super area. Needless to say that, on the contrary, if the final calculations/ measurements for arriving at super area is less than the original super area;the excess amount shall be immediately refunded by Company.

Looking forward to get complete calculations and certified/ supporting documents as requested above immediately/ latest by (mention date)

If you have difference with the builder than you have to go to court-consumer or otherwise and at that time you should weigh the expenses and efforts that you may incur if you go to court and what the builder is asking.

This is because of the indian judicial system, which leads to fearless behaviour of criminals and they creat ways and means to loot the trapped common public.

Even common man thinks that instead of going to court, i will pay to these dacoits and temporarily the problem will be solved.
